Oil pipeline construction bill public testimony – part 1

REPRESENTATIVE FABIAN FEBRUARY AND THANK YOU; MR. CHAIR. THANK YOU MR. CHAIR AND COMMITTEE MEMBERS. BEFORE I FORGET MR. GERARD LIKE TO ASK FOR A ROLL CALL ON THIS.>>REPRESENTATIVE GAROFALO:>>REPRESENTATIVE FABIAN: FIRST LET ME SAY A BEEN A STRONG ADVOCATE FOR THE LINE REPLACEMENT PROJECT. LARGELY BECAUSE I REPRESENT THE GREAT FOLKS OF NORTHWEST MINNESOTA BASED ON THEIR COMMENTS TO ME TO ME IN THE TESTIMONY THEY HAVE SHOWN AND GIVEN AT HEARINGS IN THE THIEF RIVER FALLS AND THE FACT THAT THEY SHOULD UP WEARING THEIR GREEN SHIRTS AND SO FORTH SUPPORTING UNIT JOBS FOR THOSE FOLKS VERY VERY STRONG SUPPORT THE LINE REPLACEMENT PROJECT. I ATTENDED TWO HEARINGS IN THIEF RIVER FALLS LAST FALL ON THIS AND IT WAS VERY VERY IMPRESSED BY THE PRESENCE IN THE DECORUM OF THE PEOPLE THAT ATTENDED THE MEETING FROM THAT AREA THAT SUPPORT OF THE LINE 3 REPLACEMENT. MY HAT GOES OFF TO THEM. REALLY ADMIRE THE LG YOU THAT SHOULD UP THERE;; THE SCHOOL DISTRICTS; THE TOWNSHIPS AND COUNTIES THE FIRST RESPONDERS THAT TALKED ABOUT HOW IMPORTANT LINE REPLACEMENT IS TO THEIR LOCAL ECONOMIES IN THE LOCAL SCHOOL DISTRICTS AND SO FORTH. YESTERDAY IT WAS REPORTED THAT [INAUDIBLE] CANADIAN OIL PRODUCERS IS CUTTING PRODUCTION BECAUSE A LACK OF PIPELINE CAPACITY. THIS OIL COMPANY WANTS TO SELL MORE OF ITS PRODUCT IN THE WORLD MARKET BUT CAN’T FIND A WAY TO GET ITS OIL TO ITS CUSTOMERS. SOME OF THOSE CUSTOMERS ARE RIGHT HERE IN MINNESOTA. I KNOW A LOT OF PEOPLE IN THIS ROOM WILL HEAR THIS NEWS AS AN ENCOURAGING DEVELOPMENT IN THE WAR ON FOSSIL FUELS .. I RESPECT SOME OF THAT. YET THE STATE DEPARTMENT OF COMMERCE MAINTAINS LINE 3 REPLACEMENT PROJECT IS NOT NEEDED AND THERE’S NO LONGER ANY DEMAND FOR CRUDE OIL. EVERYONE IS A BARELY CHANGE OVER TO ELECTRIC CARS AND LIKE CHAIR GAROFALO. BUT BOTH OF THESE THINGS CAN’T BE TRUE; MEMBERS. EITHER THERE IS NO MORE DEMAND FOR CRUDE OIL THERE SO MUCH DEMAND THAT OIL PRODUCERS ARE HAVING TO CUT BACK PRODUCTION IS THE LACK OF PIPELINE CAPACITY. I DON’T KNOW WHICH ONE -I’M A SCIENCE TEACHER AND TRACK COACH FROM NORTHWEST MINNESOTA AND I LIVE IN MY REAL WORLD AND THE WORLD THAT IS THE PEOPLE I REPRESENT IN THIS PROJECT WILL CREATE MANY; MUCH-NEEDED JOBS AND ECONOMIC ACTIVITY AND ONLY WILL CREATE JOBS IT’S G OT IT’S GOING TO SUSTAIN A LOT OF JOBS UP THERE. ECONOMIC ACTIVITY IN NORTHERN MINNESOTA IS GONNA CREATE A ADDITIONAL TAX REVENUES FOR LOCAL COMMUNITIES. AS MENTIONED LOCAL SCHOOL DISTRICTS; TOWNSHIPS COUNTIES IN THE DIRECT IMPACT IT SOUNDS LIKE-COSTED AND YOU HOLDEN FOR THESE WORKERS COME UP AND SPEND A SUMMER WORKING ON A PROJ ECT IN THE MONEY THEY SPEND IN THE LOCAL GROCERY STORES AND THE BAYS AND THE GAS STATIONS AND ALL THOSE OTHER PLACES IS SOMETHING THAT’S REALLY REALLY NEEDED IN OUR SMALL COMMUNITIES. IF YOU SPEND ANY TIME IN NORTHWEST MINNESOTA AND A LOT OF WHAT I REFER TO IS DEEP RURAL MINNESOTA THIS ECONOMIC ACTIVITY IS VITAL TO THE PEOPLE IN OUR LOCAL GOVERNMENTS. LANGUAGE IN HOUSE FILE 3759 IS ESSENTIALLY THE SAME LANGUAGE THAT CHAIR GAROFALO HAD AMENDMENT AND LAST YEAR’S OMNIBUS BILL OMNIBUS BILL OMNIBUS BILL OMNIBUS BILL OMNIBUS BILL OMNIBUS BILL OMNIBUS BILLTHO SE PROPOSEDSHORT-CIRCUIT THE WORK OF THE PUBLIC UTILITIES COMMISSION COULD SINCE LAST MAY THE PROCESS HAS PLAYED UP YET ALL THE PUBLIC HEARINGS HAVE BEEN HELD AND I WILL CHECK THAT. WAS WHEN IT’S IN CLUB BUT DID NOT GET HELD BECAUSE OF THE ALG CANCEL THAT IN ST. CLOUD AFTER SIGNIFICANT DISRUPTION AND THE ONE IN DULUTH ALL THE EVIDENTIARY HEARINGS HAVE BEEN HELD ALL THE TESTIMONY OFFERED; ALL THE EXHIBITED COLLECTED. THE FINAL IMPACT STATEMENT IS BEEN ISSUED ACCEPTED BY THE PUC. ALL THAT’S LEFT THESE FINAL DECISIONS. IF WE DON’T ACT ON MY BILL THE PUC WILL DECIDE THE FATE OF LINE 3. IN THE PUC-YOU’VE HEARD ME [LAUGHING]>>[GAVEL]>>CHAIR GAROFALO: FOLKS; AGAIN WITH HER PRO-OR ANTI-IIF YOU COULD KEEP APPLAUSE; HISSING; BOWLING; LAUGHTER GENERAL REACTIONS TRY TO KEEP IT TO A MINIMUM SO WE CAN CUT THE BUSINESS OF THE COMMITTEE GOES WHETHER THERE’S PROPONENTS OR OPPONENTS OF THE BILL TESTIFYING I WOULD EXPECT THE SAME ON THE OTHER SIDE. REPRESENTATIVE FABIAN; PLEASE CONTINUE.>>[INAUDIBILE / OFF MIC]>>CHAIR GAROFALO: REPRESENTATIVE FABIAN TO WANT TO USE THE MOVE THE MICROPHONE A LITTLE CLOSER TO YOU?>>REPRESENTATIVE FABIAN: SURE. [INAUDIBLE] PERSONALLY I’M NOT AFTER THE PUC MEMBERS PERSONALLY I KNOW THEY HAVE A JOB TO DO. THEY HAVE BEEN APPOINTED TO THE POSITIONS THEY ARE IN. BUT YOU’VE HEARD ME ACCESS MY CONCERNS ABOUT THE LACK OF WHAT I REFER TO AS ROW REPRESENTATION I FEEL LIKE A BROKEN RECORD WHEN I TALK ABOUT THIS. THE DISTANCE FROM THIS CAPITAL THE AVERAGE DISTANCE OF THE MEMBERS OF THE PUC LIVE IS LESS THAN 20 MILES. THERE’S NO ONE WHO SERVES ON THE PUC WHOSE NORTH OF RAMSEY COUNTY. I’VE EXPRESSED MY DESIRE TO TRY TO FIGURE OUT A WAY TO GET MORE REGIONAL REPRESENTATION ON THE PUBLIC UTILITIES COMMISSION. YOU WILL HEAR THIS AFTERNOON AND MAY HAVE HEARD EARLIER HOW THIS DECISION MUST BE LEFT TO THE TECHNICAL EXPERTS AT THE PUC. MEMBERS; ALL THE TECHNICAL WORK HAS BEEN DONE. ON THE APPLICATION AND THE PROPOSED ROUTE HAS BEEN COMPLETED. THERE’S NO MORE WHAT I REFER TO AS TECHNICAL WORK THAT NEEDS TO BE DONE. ALL THAT’S LEFT IS A DECISION. I AM CONCERNED THAT IT MAY BECOME A POLITICAL DECISION SHOULD THE PUC SIDE WITH PEOPLE WHO ARE OPPOSED TO THE PIPELINE WHERE SHOULD THE PUC SIDE WITH THE COMMUNITIES AND THE PEOPLE OF NORTHERN MINNESOTA? THE STRETCHES ALL ACROSS THE NORTHERN TIER OF THE STATE. IT GOES FROM NORTH DAKOTA OVER TO DULUTH. I DON’T BELIEVE IT’S A TECHNICAL CHOICE AT THIS POINT. I’M CONCERN IS BECOMING A POLITICAL CHOICE. THE PUC ACCORDING TO THE REPORTS I’VE SEEN SOMETHING TO ISSUE A DECISION ON THIS PROJECT UNTIL AFTER THE LEGISLATURE ADJOURNED. I’M CONCERNED THAT THE PEOPLE IN NORTHWEST MINNESOTA AND ACROSS NORTHERN MINNESOTA ARE GOING TO ASK ME WHEN WE ARE ALL DONE SHOULD THE PUC DECIDE TO NOT MOVE FORWARD WITH THIS PROJECT I’M GOING TO GO BACK HOME THEY’RE GOING TO BE DISAPPOINTED AND THEY WILL SAY WHAT DID YOU DO. WHAT DID YOU TO REPRESENT ME? WHAT DID YOU DO TO REPRESENT US; TO MAKE SURE LINE 3 REPLACEMENT GETS DONE. THAT’S WHAT I’M DOING HERE TODAY. I’M REPRESENTING MY CONSTITUENTS AND ANYBODY WHO KNOWS ME KNOWS FULL WELL THATI REPRESENT MY CONSTITUENTS WITH A LOT OF PASSION AND RESPECT EVERYBODY ELSE HERE WHO REPRESENTS THEIR CONSTITUENTS WITH A LOT OF PASSION AND WE HAVE A VERY SHORT CONSTRUCTION SEASON AND THIS IS IN TEXAS. IT’S PRETTY HARD TO TOBACCO INTO THE GROUND AND DIG A TRENCH IN JANUARY AND FEBRUARY AND MARCH THOSE TIMES OF THE YEAR. IF YOU SPENT ANY TIME IN KITCHEN COUNTY OR MARSHALL COUNTY YOU KNOW OUR CONSTRUCTION SEASONS ARE VERY SHORT. I WANT TO MOVE THIS BILL FORWARD TODAY IS THE DAY. TO SHOW YOUR SUPPORT FOR HOUSE FILE 3759 AND I LOOK FORWARD TO A NICE CONVERSATION WITH YOU FOLKS. THANK YOU MR. CHAIR>>CHAIR GAROFALO: TH ANK YOU REPRESENTATIVE FABIAN COMMISSIONER- AND THE NEXT TESTIFIER LIST I’VE RON WETZEL. FIRST OF ALL I WOULD APOLOGIZE IF I SAID ANYONE’S NAME ON. THEN; SHANIA MADISON. SO YOU TWO ARE ON DECK AND FEEL FREE TO COME DOWN SOON AS THE COMMISSIONER IS THE WELCOME TO THE COMMITTEE. STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY. AND FOR SO WELCOME TO THE COMMITTEE FOR YOUR FIRST TIME AS THE CAPACITY AS COMMISSIONER>>TESTIFIER: THANK YOU; MR. CHAIR FAQ MEMBERS OF THE COMMITTEE. I WANT TO THANK REPRESENTATIVE FABIAN FOR A VERY THOUGHTFUL CONVERSATION ABOUT THIS.>>REPRESENTATIVE GAROFALO: YOU DO HAVE TO INTRODUCE YOURSELF.>>TESTIFIER: I’M SORRY. [INAUDIBLE] THE ADMINISTRATION OPPOSES THIS BILL 37 TO 59. FOR SEVERAL REASONS. FIRST; THE PUC IS THE APPROPRIATE VENUE FOR WHETHER THE PIPELINE SHOULD BE BILL. THOUSANDS OF STATE AGENTS; LABOR ENVIRONMENTS OR GROUPS; YOU MR. LODGE AND OTHER STAKEHOLDERS OF ALL PARTICIPATED RIGHT INPUT IN THIS IMPORTANT DECISION. THE PUC IS CHARGED WITH WEIGHING ALL THE INFORMATION RECEIVED IN A JUDICIOUS AND OBJECTIVE MANNER-MANNER BASED ON FACTS ASSOCIATE WITH NEED IMPACT AND BENEFITS TO THE STATE. SECOND; HOUSE FILE 3759 ALLOWS-AAT SOLE DISCRETION TO CONSTRUCT THE PIPELINE ON ITS PREFERRED ROUTE. NOT ONLY DOES THIS PROVISION NEED THE ROUTING PERMIT PROCESS IT ALSO ALLOWS AMPERAGE TO ACQUIRE THE LAND FOR PRIVATE COMMERCIAL PURPOSE. 3759 DISREGARDS TRIBAL TREATY RIGHTS THE WISHES OF OTHER PRIV ATE LANDOWNERS ALLOWS AMPERAGE TO CONSTRUCT LINE 3 IS PREFERRED ROUTE WITHOUT REGARD TO THE IMPACTS ROUTE WOULD HAVE ON THE SURROUNDING ENVIRONMENT. YOU ARE MENTALLY NEXT AVON PROCESS IS CURRENTLY UNDERWAY AT THE PUC ALLOWS FOR INDEPENDENT SCIENTIFIC EVALUATION OF THE PROPOSED PROJECT PROJECT ALTERNATIVES 20 TO FIGHT ABOUT THE LEAST OF OUR MENTAL ECONOMIC AND SOCIE TAL IMPACT. AMPERAGE SHOULD NOT BE ALLOWED TO BUILD LINE 3 BEFORE THIS PROCESS IS COMPLETED BECAUSE AVERAGE PREFERRED ROUTE MAY NOT BE THE BEST ROUTE AND IN THE BEST INTEREST OF MINNESOTANS. DECISIONS ON ROUTES AND ROUTE ALTERNATIVES ARE BEST DEALT WITH BY THE IMPARTIAL VENUE AT THE PUC AS OPPOSED TO THROUGH PRIVATE DISPOSITION. THIRD; CIRCUMVENTING THE PERMIT PROCESS MAY PUT MINNESOTANS AT RISK. IN THIS CASE RISK INCLUDE ACCIDENTAL RELEASE OF TOXIC AND COMBUSTIBLE MATERIALS THROUGH PIPELINE FAILURES OR HOSTI LE ACTION. THIS IS OF GREAT CONCERN BECAUSE THE HOUSE FILE 3759 DOES NOT ADDRESS OIL SPILLS ; OIL SPILL CLEANUP; ASSURANCES FINANCIAL INSURANCES THAT WOULD BE NEED TO BE MADE TO THE STATE AND ITS CITIZENS WOULD OTHERWISE BE ADDRESSED IN A PERMIT ACTUALLY ISSUED BY THE PUC. FINALLY; UNDER THIS BILL MINNESOTA LANDOWNERS BUSINESSES COMMUNITIES AND RESIDENTS MAY END UP WITH A FONT PILOT PROJECT THEY DON’T NEED . THE CERTIFICATE OF NEEDED ROUTING PERMIT PROCESS OF THE PUC SEEK TO AVOID THE BUILDING OF A NECESSARY AND COSTLY FACILITIES IN OUR STATE. THE PUC CAN TAKE INTO ACCOUNT ALL THE FACTS DATA SCIENCE AND TECHNICAL EXPERTISE IT’S BEEN PROVIDED DURING THIS PROCESS. AND DEVELOP-HAS DEVELOPED ALL THE DEVELOP HAS BEEN DEVELOPED AND SHARED BY THE PROJECT IN THE PUC CAN PROVIDE A DETERMINATION ABOUT WHETHER THE LINE 3 IS PROJECT IS NEEDED FOR THE BENEFIT OF MINNESOTA. THANK Y OU FOR CONSIDERING THE ADMINISTRATION’S OPPOSITION OF HOUSE FILE 3759. WE HOPE THE INFORMATION IS HELPFUL AND I URGE THE COMMITTEE TO VOTE AGAINST THE BILL. THANK YOU.>>CHAIR GAROFALO: THANK YOU FOR YOUR TESTIMON Y COMMISSIONER. REPRESENTATIVE MAHONEY WE ARE NOT GOING TO TAKE QUESTIONS. [INAUDIBILE / OFF MIC]. YOU WANT TO CORRECT REPRESENTATIVE FABIAN? [INAUDIBILE / OFF MIC]. COMMISSIONER YOU TO HAVE TO BE ANOTHER COMMITTEE DURING OR ARE YOU STICKING AROUND?>>TESTIFIER: I CAN BE IF YOU NEED ME.>>CHAIR GAROFALO: JUST GO AHEAD NOW.>>REPRESENTATIVE MAHONEY: REPRESENTATIVE FABIAN SAID WE DON’T HAVE IT ANYMORE NEED FOR OIL AND I THOUGHT THE STATEMENTS WAS THAT WE HAD-THAT THE DEPARTMENT OF COMMERCE SAID THERE WAS AN ADEQUATE CAPACITY TO DO AT ANY TIME DID YOUR AGENCY AND ON-TIME SAY THAT WE DIDN’T NEED ANY MORE OIL?>>TESTIFIER: AGAIN THE TECHNICAL WORK THAT’S BEEN DONE BY LONGTIME REGULATORY STAFF STANDS ON ITS OWN AND IS BEFORE THE PUC. REALLY DEBATING THE MERITS OF THE APPLICATION IS NOT APPROPRIATE AT THIS TIME IN FRONT OF THIS BILL. THIS IS ABOUT PROCESS AND ENSURING THE PUC CAN EVALUATE WHERE THE DEPARTMENT OF COMMERCE HAS DONE AS WELL AS ALL THE OTHER STAKEHOLDERS THAT PROVIDED INPUT INTO THE PROCESS.>>CHAIR GAROFALO: THANK YOU COMMISSIONER. APPRECIATE YOUR TESTIMONY. MR. WESSEL IF YOU WANT TO COME DOWN AND MS. MADISON IF YOU WANT TO COME DOWN AS WELL? WELCOME TO THE COMMITTEE. STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: THE NAME IS RON WEXLER.. WEREN’T WE JUST HEAR? ALL RIGHT. IT WAS IN THE CLOSING DAYS OF THE 2017 LEGISLATIVE SESSION I THINK; WHEN REPRESENTATIVE GAROFALO INSERTED LANGUAGE INTO THE OMNIBUS BILL THAT WOULD RELIEVE AMPERAGE FROM NEEDING TO OBTAIN A CERTIFICATE OF NEED THE STATE OF MINNESOTA TO THIS PROJECT AND PREVENTED ANY GOVERNMENTAL FUNCTION OFFICE OR PERSON FROM CONSIDERING ROUTING THAT ALTERED FROM WHAT AMPERAGE STIPULATED. I THINK THAT IS RIGHT. TWO THINGS STRUCK ME THEN AS THEY DO NOW. FIRST; IN EFFECT; AMBRIDGE WAS ; IS; ASKING TO BE BELIEVED OF THE BURDENS OF MEETINGS; MEETING MINNESOTA STANDARD REGULATION FOR THESE PROJECTS. SECONDLY; WANTING TO BE BELIEVED FROM CUSTOMARY STANDARDS; REGULATION; HAS TO BE TACIT ADMISSION BY AMBRIDGE THAT THEY HOLD IT WE CAN’T WITH REGARD TO THE MERITS OF THE CASE. EVIDENTLY; MEETING THE STANDARD OF CUSTOMARY MINNESOTA REGULATION IS TOO ONEROUS OF A THRESHOLD FOR AMBRIDGE IN THIS PROJECT. AS WE GO FORWARD AND THROUGH THE MOTIONS OF PUBLIC COMMENTS TODAY LET US ALL BE CLEAR I’D AND RECOGNIZE THAT IN THE SAME WAY THAT YOU HAVE THE VOTES IN HAND LAST SESSION TO PUSH THIS THROUGH; EVERYONE HAS TO KNOW THAT YOU’VE GOT THEM IN YOUR BACK POCKETS. NOW; SO AFTER YOU PUSH THIS THROUGH AND THEN FRONT AND CENTER PREENING AMONG YOURSELVES FOR BEING AMBRIDGE IS WATER BOY; DON’T GO TOO FAR BECAUSE THERE IS AN ILL WIND THAT WILL FOLLOW. CERTIFICATE OF NEED; OH MY. THAT IS JUST TO O UNREASONABLE. CONFERENCE OF ANALYSIS OF ROUTING; THAT IS SUCH A WASTE OF TIME. TRIBAL CULTURAL SURVEY; PLEASE. WE HAVE SEEN ROADS INDIGENOUS NATION FROM DAY ONE; WHY WOULD WE STOP NOW. CONGRATULATIONS FOR BRINGING STANDING ROCK TO MINNESOTA.>>REPRESENTATIVE GAROFALO: IS MADISON. THEN STAN–[APPLAUSE] STAN?>>TESTIFIER: HELLO. THANK YOU TO THE COMMITTEE. MY NAME IS SHANIA MEDICINE AND I SPLIT MY TIME BETWEEN MINNEAPOLIS AND AIKEN COUNTY. WHICH IS WHERE I’M FROM NORTHERN AIKEN COUNTY. I WAS THERE EARLY THIS MORNING TAKING A WALK WITH MY TWO CHILDREN . THEY WERE AMBRIDGE WANTS TO PUT THEIR OIL PIPELINE ACROSS THE WILLOW RIVER AND THE MISSISSIPPI. I THOUGHT TO MYSELF; HOW MY GOING TO EXPLAIN THIS TO MY KIDS? HOW MY GOING TO TELL THEM THAT THEIR NEIGHBORS AND THEIR GOVERNMENTS HAVE AGREED TO LET A CORPORATION THAT ONLY PUT IN OIL PIPELINE HERE AND FAST-TRACK AN OIL PIPELINE THROUGH A WET SWAMPY GROUND ACROSS LIVING RIVERS WHISKING ALL OF OUR LIVES. I’M NOT A PROFESSION AL LOBBYIST I’M NOT AN ACTIVIST MACHINE ACTUALLY IS TAKEN ME THIS LONG TO COME AND TESTIFY AT ONE OF THESE HEARINGS. I’VE MADE PUBLIC COMMENTS. THE APPROVAL PROCESS OF BEEN CONFUSING TO ME AND TO MY FAMILY AND THE PEOPLE IN MY COMMUNITY. WHO YOU ARE RIGHT; DO YOU WANT JOBS ANY JOBS. BUT NO ONE HAS EVER SEEMS TO US WHAT KIND OF JOBS WE JUST RESPOND TO PROJECTS LIKE A PROPOSED BY PEOPLE FROM OUTSIDE. I HAVE LOOKED AT THE EIS AND I LOOKED AT THE MAPS ALSO GREW UP ON THAT LAND AND ITS PROJECT DOESN’T MAKE ANY SENSE TO ME. RALPH DOESN’T MAKE ANY SENSE. I LEFT MY HOMETOWN WHEN I TURNED 18 BECAUSE THERE WAS SO FEW CHOICES FOR JOBS. AND BECAUSE I WANT TO SEE AN EXPENSE THE WORLD BEYOND THE PLACE I GREW UP REALLY GLAD I DID. SOMETIMES YOU HAVE TO LEAVE THE PLACES YOU LOVE TO APPRECIATE HOW SPECIAL THEY ARE. TO UNDERSTAND HOW SPECIAL YOU ARE TO COME FROM A PLACE WHERE PEOPLE STILL HAVE A CONNECTION TO THE LAND AND WATER THAT SUSTAINS THEM. WE CAN STILL SWIM IN THE MISSISSIPPI RIVER WHERE I COME FROM. THIS IS INTO WHERE I SPEND MOST OF MY TIME NOW IN MINNEAPOLIS. MOST OF MY NEIGHBORS AND FRIENDS EVEN THE ONES WHO THINK OF THEMSELVES AS BEING VERY AWARE OF THEIR ENVIRONMENTAL FOOTPRINT; DON’T KNOW THEY ARE DRINKING WATER COMES FROM THE MISSISSIPPI. THEY DON’T KNOW THAT SAME RIVER WILL BE PUT AT RISK BY THE PIPELINE IT’S SPELLED SO THIS WATER CONNECTS ALL OF US AN D I THINK ALL OF US HAVE NOT HAD A VERY GOOD JO B OF CONSIDERING THE WAYS THAT WE ARE CONNECTED TO THE WATER AND HOW IMPORTANT IT IS TO US. GROUNDWATER IN AIKEN COUNTY IF ANY OF YOU HAVE BEEN THERE IT’S VERY WET PLACE IT’S VERY PURE GROUNDWATER THAT’S BEEN PROTECTED BY THOSE WETLANDS FOR GENERATIONS. THOSE GENERATIONS INCLUDE MY GREAT GRANDPARENTS; MY GRANDPARENTS MY PARENTS AND I’M LOOKING FOR WAYS I CAN GET BACK TO MY COMMUNITY AND HELP PROTECT THAT WATER. I’M WORRIED THAT IF THIS PIPELINE IS BUILT WILL VERY FEW CHOICE OF WHAT WE CAN DO THERE. BECAUSE IF YOU’VE BEEN THERE AND STOOD AND LOOKED AT THE RIVER AND LOOKED AT THE WETLANDS AND YOU CAN IMAGINE A PIPELINE TEARING THAT UP I’VE BEEN TO THE PIPELINE PROJECTS AND SO THEY DO TO THE LAND. I CANNOT IMAGINE HOW YOU COULD DO THAT AND STILL HAVE A RANGE OF OPTIONS FOR JOBS INTO THE FUTURE AND NOT ONLY JOBS BUT OUR LIVES. THE CLIMATE CHANGES WHICH IS;; WHEN IT’S WARMER AND WE DON’T KNOW WHAT WE WILL NEED TO DO TO LIVE AND SURVIVE OR HOW MUCH WE WILL NEED THAT WATER TO BE CLEAN FOR FUTURE GENERATIONS; WE ARE JUST CLOSE ENOUGH CHOICES THAT WE COULD HAVE. THAT REALLY REALLY CONCERNS ME. WHEN PEOPLE IN MY HOMETOWN ARE SICK OR THEY NEED HELP WITH SOMETHING WE COME TOGETHER AND WE THREW A POTLUCK. WE HANG OUT. WE HELP EACH OTHER SOLVE THOSE PROBLEMS. WE DON’T ASK WHAT IS THE PROFIT GOING TO BE. DON’T ASK IS THIS CAN HELP A COMPANY THAT’S NEVER CARED ABOUT THIS PLACE BEFORE AND PROBABLY WON’T AFTER THEY GET THEIR PROJECT DON’T DONE.. WE GATHER AND TO THAT I THINK WHEN TOGETHER NOW ASK OURSELVES THOSE QUESTIONS. IT’S ACTUALLY TOO LATE IT SEEMS IF THIS BILL GOES FORWARD AND THIS IS JUST FAST-TRACK. WHAT WAYS OF LIFE ARE WE WILLING TO GIVE UP TO TURN A PROFIT FOR COMPANIES LIKE AMBRIDGE HOW DO WE PLAN TO FILL THE RISK IS ALREADY CREATING? BROUGHT WATER WITH ME TODAY IF YOU HAVE IT MY BACK IF ANYONE WANTS TO TRY AND DRINK IT COMES FROM A FARM THAT WAS ON THE PIPELINE ROUTE AND THE FARMER DECIDED NOT TO SELL HER LAND. SHE HAS BEEN BULLIED BY AMBRIDGE HER NEIGHB ORS NOW THERE ARE PEOPLE WHO ARE FRIENDS AND NO LONGER TALK TO ONE ANOTHER IS ONE CONCERN ALSO WITH THE START OF THE FABRIC OF THE SOCIAL FABRIC OF OUR COMMUNITY. I TRAVELED TO A LOT OF PLACES WERE PROJECTS LIKE THIS HAVE HAPPENED AND WHAT HAPPENS TO THE LAND HAPPENS TO OUR COMMUNITY. WHAT HAPPENS TO OUR BODIES AND HAPPENS TO US. THOSE PLEAS WERE PROJECTS LIKE THIS ARE ALLOWED TO BE FAST TRACKED PEOPLE ARE PUSHED AROUND; TOO. THEY GET SICK. WHAT WE DO TO LAND WE DO TO OURSELVES. I WOULD JUST LEAVE IT WITH THAT. I REALLY AM OPPOSED TO THE PROJECT. I HAVE COPIED AND GAZED AS I SHOULD BE BUT I AM NOW AND I AM IN SUPPORT OF THE PEOPLE WHO ARE RESISTING THIS PROJECT I’M ALSO CONCERNED FAST TALKING THIS IS GOING TO LEAD TO VIOLENCE BECAUSE I HAVE HEARD THAT POLICE DEPARTMENT’S ARE PREPARED TO [INAUDIBLE] LIKE STANDING ROCK AND WHEN WE GET HYPED UP LIKE THIS AND DIVIDE BY MONEY AND POLITICS NOTHING GOOD CAN COME FROM THAT. I HOPE THOSE ARE ALSO THINGS YOU ARE CONSIDERING. THANK YOU.>>REPRESENTATIVE GAROFALO: THANK YOU FOR YOU R TESTIMONY. [APPLAUSE] FOLKS COME AGAIN;>>[GAVEL]>>CHAIR GAROFALO: THEN FROM DULUTH GREG–YOU ARE ON DECK AND WELCOME TO THE COMMITTEE STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: CHAIRMAN GAROFALO AND MEMBERS OF THE COMMITTEE; I’ M STAN SALINGER; A LICENSED MECHANICAL ENGINEER AND HAVE FOLLOWED AND TESTIFIED IN QC CRUDE OIL PIPELINE CASES LINE 67; LINE 3 ; AND SANDPIPER. I WANT TO GO ON RECORD AS COMPLETELY OPPOSING TO HOUSE FILE 3759. THIS ACT IS CLEARLY DEVISED TO GREENLIGHT THE LINE 3 REPLACEMENT SOCCER PROPOSE BY AMBRIDGE. BUT IT IS TOTALLY OPEN-ENDED. MEANING THAT; TOMORROW IF THEY ASKED IF PAST DEVELOPERS ARBITRARILY IDENTIFY PROPOSALS AND PROCEED TO PROCEED TO BUILD ANY PREVALENCE THEY WANT TO AND ORGANIZE CONSIDERATION OF THE RESULTS OF DOING SO. THE CONSEQUENCES WOULD BE MUCH LIKE A TRANSPORTATION COMPANY PUTTING SOME LINES ON A MAP AND PROCEEDING TO BUILD A RAILROAD TO PRIVATE PROPERTY ALONG THESE LINES TOTALLY UNRESTRAINED BY ANY REQUIREMENTS TO ASSESS THE RESULTING SOCIAL AND ENVIRONMENTAL IMPACTS. THIS APPARENTLY HAPPENED AT SOME POINT IN OUR HISTORY ENGAGING OUR COMMON REFERENCES TO THE TERM; RAILROADING. YOU MUST NOT REVERT TO THIS WAY OF CONDUCTING INFRASTRUCTURE PROJECTS. THE APPLICATION OF MINNESOTA RULES; CHAPTER 75 OF MINNESOTA RULES; CHAPTER 75.2 – EXCUSE ME – AND 785.3 TO THE NEED AND ROUTE PERMITSFOR LINE 3 OR ANY OTHER PIPELINE WOULD BE DISMISSED UNDER THIS PROPOSED ACT. OBSTRUCTED BE THE CONSIDERATION OF SUCH KEY QUESTIONS AS; ARE THERE ALREADY ADEQUATE SUPPLIES OF CRUDE OIL TO MINNESOTA QB WOULD IS THERE A MORE REASONABLE ALTERNATIVE TO THE PROJECT? ARE THE CONSEQUENCES OF DENYING CERTIFICATE OF NEED MORE FAVORABLE THAN THE CONSEQUENCES OF GRANTING IT? HAS THE PROJECT AND SHOWN TO SATISFY ALL RELEVANT POLICIES AND REGULATIONS? IN SHORT; WITH THE PROJECT BE BENEFICIAL TO THE PEOPLE OF MINNESOTA? FOR NEW PIPELINE PROJECTS THESE ASSURANCES WOULD BE TOTALLY ELIMINATED. THE PUBLIC’S RIGHTS UNDER STATE LAW TO THE PROTECTION OF IRREPLACEABLE RESOURCES WILL BE VIOLATED AND OUR CLIMATE FOOD AND DRINKING WATER WOULD BE PLACED FURTHER AT RISK. FOR LINE 3; MANY OF THESE ISSUES HAVE ALREADY BEEN PARTLY ADDRESSED IN THE CONTESTED CASE BEFORE THE PUC.LINE 3 CASE SHOULD BE ALLOWED TO CONCLUDE WITHOUT THE INTERFERENCE OF THIS PROPOSED ACT. THANK YOU FOR THIS OPPORTUNITY TO SPEAK.>>REPRESENTATIVE GAROFALO: THANK YOU FOR YOUR TESTIMONY. MR.–BECAUSE WELCOM E TO THE COMMITTEE. STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: MY NAME IS GREG ORGY I AM FROM DULUTH MINNESOTA NORTHERN MINNESOTA IN WHICH THERE IS FIERCE OPPOSITION TO AMBRIDGE LINE 3. I CAN ATTEST TO THAT AS I WAS AT THE HEARING AT THE PUC WAS HOLDING. I WANTED TO SAY THAT I’M ALSO A VETERAN FOR PEACE AND AM AWARE THAT EXPANDING ROCK STANDING ROCK 1000 MORE VETERANS WENT TO STAND WITH THE WATER PROTECTORS. I AM AWARE THAT AMBRIDGE HAS STUDIED STANDING ROCK BECAUSE I ASKED THAT QUESTION AND [INAUDIBLE] HAD SAID; YES THEY HAD STUDIED STANDING ROCK. I JUST WANTED TO PUT A COUPLE THINGS IN CONTEXT IN THE NEWS WE DO SEE QUITE A BIT ABOUT FOSSIL FUEL COMPANIES MAYBE EVERYONE IS ALREADY AWARE THAT NEW YORK CITY HAS ANNOUNCED THEY INTEND TO SUE FOSSIL FUEL COMPANIES. THEY SAY IT’S COMPARABLE TO CIGARETTE COMPANIES FOSSIL FUEL COMPANIES ARE RESPONSIBLE FOR KILLING PEOPLE AND THEN I DID JUST A GOOGLE SEARCH THIS MORNING. I HE ARD ARNOLD SCHWARZENEGGER HAD GIVEN A SPEECH ABOUT THIS TOPIC. I DID A GOOGLE SEARCH. ARNOLD SCHWARZENEGGER; A FORMER REPUBLICAN GOVERNOR OF CALIFORNIA GAVE A SPEECH IN TEXAS SAYING HE INTENDS TO SUE BIG OIL COMPANIES FOR FIRST-DEGREE MURDER. HE SAID THAT THEY ARE KNOWINGLY KILLING PEOPLE ALL OVER THE WORLD OIL COMPANIES NEW FROM 1959 ON BECAUSE THEY HAD DONE THEIR OWN STUDY THAT GLOBAL WARMING IS PARTIALLY DUE TO FOSSIL FUELS. AND THAT IT WOULD KILL PEOPLE. THE LAST THING I WANT TO SAY IS THAT IT WAS A SURPRISE TO ME TO HEAR THAT THIS BILL WOULD HAPPENING THIS WEEK AND I JUST HAPPEN TO BE ON FACEBOOK AND GET THIS NOTICE. BUT IT DOES SEEM APPROPRIATE. FOR THOSE OF YOU WHO MIGHT ATTEND CHRISTIAN CHURCHES; THIS IS KNOWN AS HOLY WEEK. ON SUNDAY WE HAD THE REMEMBERING GOSPEL OF JESUS ENTERING ON PALM SUNDAY. THIS IS THE WEEK THAT JESUS DISRUPTED BUSINESS AS USUAL. TURNING OVER THE TABLES IN THE TEMPLE. SAYING; STOP THE EXPLOITATION OF POOR PEOPLE. THIS SEEMS TO BE VERY APPROPRIATE THAT THIS BILL IS TRYING TO CONTINUE THE CRUCIFIXION OF JESUS TODAY ; CRUCIFYING POOR PEOPLE AND MANY OF WHOM ARE NATIVES ARE FIERCELY OPPOSED TO THIS. THANK YOU.>>REPRESENTATIVE GAROFALO: THANK YOU FOR YOUR TESTIMONY. MS. NOW. AND MARY FROM–MARY; ARE YOU HERE? SO YOU ARE ON DECK. WELCOME TO THE COMMITTEE. STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: MY NAME IS MICHELLE–BUT I COME FROM DULUTH MINNESOTA. FIRST I WANT TO SAY I’M HAVING A HARD TIME EVEN UNDERSTANDING WHY WE ARE DOING THIS HOW THIS COULD EVEN COME TO THE STAGE. WE HAVE A SERIES OF CHECKS AND BALANCES YOU HAVE PROCESSES AND WE HAVE REQUIREMENTS THAT ARE SET UP TO PROTECT PEOPLE AND THE LAND THAT’S HELD IN COMMON. THE PUBLIC UTILITIES COMMISSION HAS BEEN SET UP TO TAKE ALL OF THIS TESTIMONY THAT YOU ARE HEARING AGAIN; THIS WAS -I WAS AT TWO OF THOSE HEARINGS HERE IN THE CITY AND THE ONE IN DULUTH. MUCH OF THIS TESTIMONY THAT PEOPLE ARE PRESENTING RIGHT NOW; THE DANGERS OF THE OIL COMPANY; THE THREAT TO OUR LAND; THE OVERRIDING OF THE SOVEREIGN LAND THAT WAS CEDED TO THE SNOBBY PEOPLE IN THE TREATY RIGHTS OF 1854-1865; THEY ARE ALL BEING JUST WALKED RIGHT OVER. THIS WAS THE TASK OF THE PUBLIC UTILITIES COMMISSION TO TAKE ALL OF THIS TESTIMONY IS COME FROM THE A DIFFERENT PLACES; THE DIFFERENT CITIES AND ALL THE PEOPLE THAT REPRESENT LARGE GROUPS AND ORGANIZATIONS AND THEN TAKE THAT AND MAKE A DECISION COULD YOU ARE NOT CAPABLE OF MAKING A DECISION LIKE THIS. YOU HAVE NOT HEARD THAT TESTIMONY. THAT’S THEIR DECISION. WE ARE HOPING; WE ARE PUTTING OUR FAITH -WE ARE PUTTING OUR LIVES; IN THEIR HANDS BECAUSE WE SEE THIS AS A DIRECT THREAT TO OUR LIVES. WE DON’T HAVE TO LOOK TOO FAR TO SEE HOW LIVES WERE ELIMINATED AND THREATENED-YOU CAN LOOK OVER IN KALAMAZOO. THIS COMPANY HAS HAD A HORRIBLE TRACK RECORD OF RESPONSIBILITY AND SAFETY.. THE FEDERAL GOVERNMENT FORCED THEM TO FIX ALL OF THE LINES THAT ARE AT RISK AFTER THE KALAMAZOO DISASTER HAPPENED. LINE 5; I UNDERSTAND; THE SAME COMPANY STILL HAS BEEN PIPES .. WHY? BECAUSE THEY WERE PLACED UNDER THE STRAITS OF MACKINAC. THEY WERE NOT GIVEN THE PROPER STABILITY TO HANDLE THE CURRENTS THAT WOULD HIT THEM NOW THEY ARE BENT IN THEIR DISASTER WAITING TO HAPPEN TAKE THE MONEY THAT YOU HAVE IN YOUR COMPANY AND FIX THAT HIRE PEOPLE. HIRE LOCAL PEOPLE TO FIX THAT. THOSE ARE THE JOBS AND THEY TELL US THAT THEY INVEST IN CLEAN ENERGY AND GREEN ENERGY. YOU’D BE WELCOME-WE BE HAPPY TO WORK WITH THEM ON PROJECTS LIKE THAT. BUT YOU DON’T HAVE A FOREIGN COMPANY ASKING YOU; MR. FABIAN; [INAUDIBILE / OFF MIC] OKAY. NO ONE ASKED YOU? OKAY. AS A FOREIGN COMPANY HERE THAT IS PUTTING THE FEES IN PEOPLE’S MINDSTO WALK THROUGH OUR COMMUNITIES AND PUT US AT RISK. THIS IS A SHAME. THIS IS A SHAME THAT WE ARE TALKING ABOUT BYPASSING STATE LEGISLATION -LAWS; RULES; CHECKS AND BALANCES; PROCESSES THAT WE HAVE PUT IN PLACE. TO JUST WALK OVER THEM IS A DISGRACE. I DON’T KNOW. MAYBE THAT SOMETHING YOU ALL DO IN CANADA PEOPLE DO IN CANADA BUT IT SHOULD NOT HAPPEN HERE. THAT’S NOT WHAT OUR COUNTRY HAS BEEN SET ON. THE PEOPLE THAT-WELL I GUESS I SHOULD SAY FOR THE RECORD; I OPPOSE AGE OF 375 NINE THAT HASN’T ALREADY COME OUT IN MY TESTIMONY. I STRONGLY OPPOSE IT. THERE ARE THOUSANDS OF PEOPLE WHO OPPOSE IT WILL REGISTER THEIR VOICE AND THEIR VOICE NEEDS TO BE TAKEN INTO CONSIDERATION BY THE PEOPLE THAT HEARD IT. THANK YOU.>>CHAIR GAROFALO: THANK YOU. MS. DEL KAUTSKY AND KATHY HOLLANDER FROM MINNESOTA 350 CLIMATE SOLUTIONS. KATHY; ARE YOU HERE? IF YOU COULD COME ON DOWN. WELCOME TO THE COMMITTEE. STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: MY NAME IS MARY–. I AM A NEW TO THE PROCESS. I’VE NEVER DONE THIS BEFORE. I CAN FEEL MY HEART BEATING. IT IS IN THE BEST INTEREST OF [INAUDIBLE] IS NOT IN THE BEST INTEREST OF MINNESOTA. AS A MINNESOTA AND I OBJECT TO AMBRIDGE CIRCUMVENTING THE PROCESS THAT’S ALREADY IN PLACE. A S A CITIZEN I’M TRYING TO FIGURE OUT HOW THINGS WORK AND IT’S REALLY NOT AN EASY THING TO DO. BUT I MADE MY WAY OVER TO THE PUC FOR WEEKS OF TESTIMONY I HEARD A LOT OF EXPERTS EXPERT WITNESSES THAT WERE PROMOTING BISQUE TO OUR WATER TO FIGHT [INAUDIBLE] TO WISCONSIN FOR REFINEMENT TO SELL OVERSEAS. I DO NOT HEAR JOBS PLAN TO INFECT THEM I HEARD TEST WHY THERE WERE VERY FEW JOBS. I DO NOT HEAR ANY BENEFITS TO MINNESOTA OR MINNESOTANS. THAT THEY WOULD RECEIVE FROM THIS PIPELINE THAT MITIGATES THE RISK TO THE ENVIRONMENTS. AFTER LISTENING TO ALL THAT TESTIMONY IT SEEMS TO BE VERY SLANTED SYSTEM IN FAVOR OF AMBRIDGE; OF ONE SHIPPERS. SO; WHILE I WAIT FOR THE SYSTEM TO ITS WORK; HOUSE FILE THIS HOUSE FILE [INAUDIBLE] AND IT COMES BEFORE YOU TO CIRCUMVENT THE SYSTEM THAT JUST TRYING TO FIGURE OUT. SO I OPPOSE THIS BILL AND I URGE YOU TO DO SO AS WELL. THANK YOU.>>CHAIR GAROFALO: THANK YOU FOR YOUR TESTIMONY. MS. HOLLANDER. NEXT ALSO FROM MINNESOTA 350 CLIMATE SOLUTIONS; NANCY DULUTH. [INAUDIBILE / OFF MIC]. WELCOME TO THE COMMITTEE STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: KATHY HOLLANDER THANK YOU REPRESENTATIVE FABIAN FOR SHARING YOUR COMMEN TS AND HOW THIS BILL WAS ORIGINATED APPRECIATE HEARING IT FROM YOU I HEAR YOUR PASSION I THINK YOU’RE HEARING IT FROM US AS WELL. WE ARE EQUALLY PASSIONATE .. I’M A FULL-TIME VOLUNTEER WITH MINNESOTA 350 AND YOU TALK TO PEOPLE HERE THE CAPITAL I WOULD LOVE TO BE RETIRED AND STAY AT HOME BUT I CANS. BECAUSE I KNOW WHAT’S HAPPENING TO THE CLIMATE. THIS PAST SUNDAY MORNING WITH SOME ELSE REFERENCE OF THAT I SEPARATE A PUPPETS BEING CARRIED IN BY CHILDREN INTO A BUILDING. THE PUPPETS REPRESENTED BRINGERS OF JUSTICE PEOPLE WHO SPEAK AGAINST POWER THEY WERE PAPIER-MâCHÉ HEADS ON STICKS WITH HANDMADE SIGNS WRITTEN BY CHILDREN MY LIAR; MARTIN LUTHER KING; WINONA LODUCA WAS EVEN ON ONE OF THEM AND I DO NOTHING TO DO WITH THAT. PINK HATS. STUDENT PROTESTERS READ THE SIGNS. I CAN’T HELP BUT THINK THAT THE FOSSIL FUEL INDUSTRY IS PROBABLY THE MOST POWERFUL INDUSTRY IN THE WORLD TODAY. THE INDUSTRY HAS HAD INCREDIBLE RUN BUT THERE’S A PROBLEM. THERE IS EXCESS CARBON AND FINE PARTICULATES IN THE AIR THAT’S AFFECTING OUR HEALTH AND CLIMATE. OUR WINTERS ARE WARMING ON AVERAGE. YOU HAVE A MORE INTENSE RAINFALL EVENTS MINNEAPOLIS AND CHICAGO ARE AMONG THE FASTEST WARMING CITIES SINCE 1965 OAK RIDGE TWO CLIMATE CENTRAL. WHERE THE DISASTERS ARE TRYING TO [INAUDIBLE] THAT’S WHAT DROVE ME OUT OF MY HOUSE AND BROUGHT ME HERE TO THE CAPITAL. THE FOSSIL FUEL INDUSTRY AS A WEAK FOOTPRINT AT THE CAPITAL. THE CAMPAIGN FINANCE REPORT MENTIONED $5 BILLION RECENTLY SPENT BY AMBRIDGE. THIS YEAR. THE INDUSTRY I WOULD SAY IS NOT USED TO BEING CHALLENGED THERE KIND OF HAVING A HARD TIME WITH IT NEWS THAT THEIR PRODUCTS IN THE WAY WE TRANSPORT THE PIPELINE MAY NOT BE AS WELCOME IN THE FUTURE. [INAUDIBLE] PIPELINE COMPANIES ARE GUARANTEED RATE OF RETURN IF THEY BUILD A PIPELINE. SO WHETHER OR NOT THE PIPELINE IS FULL OF THEIR GUARANTEED RATE OF RETURN. THIS IS A PRETTY SIMPLE BILL IT JUST PROPOSES TO REMOVE THE PROPOSED PROJECT OUT OF AN EXISTING PROCESS AT ABOUT FIVE MINUTES TO MIDNIGHT AND MERELY GIVE A GREEN LIGHT TO A VERY SPECIFIC TAR SANDS CRUDE OIL PIPELINE. HIS PROJECT WAS FORCED TO HAVE THE FIRST-EVER ENVIRONMENTAL IMPACT STATEMENT FOR A CRUDE OIL PIPELINE IN MINNESOTA BY AN APPELLATE COURT SINCE TO A SUIT BY BY THE FRIENDS OF THE HEADWATERS. IT’S REALLY SHOCKING TO NEVER WAS ENVIRONMENTAL IMPACT STATEMENT BEFORE MINNESOTA FOR A PROJECT THAT’S OVER 300 MILES LONG; OVER 5000 ACRES. I THINK IT’S HIGH TIME WE HAD AN EIS. AND THE MINNESOTA SUPREME COURT WHICH EARNED HIM. THAT WAS A CHALLENGE TO THE INDUSTRY. AS REPRESENTATIVE FABIAN HAS POINTED OUT; THE PROCESS IS NOW DONE. EIS WAS DECLARED ADEQUATE. THE ONLY OTHER REMAINING PIECE REPRESENTATIVE FABIAN ALSO REFERENCED THE ADMINISTRATIVE LAW JUDGE REPORT IS DUE IN LESS THAN A MONTH AND THERE’S A PUC DECISION IN JUNE. THIS PROCESS IS ALMOST COMPLETELY DONE. I UNDERSTAND THE PROCESS PUBLIC UTILITY COMMISSIONS IS QUASIJUDICIAL AND OFFERED SOMEWHAT FROM POLITICS. AND THAT WE’VE WRITTEN IN OUR CONSTITUTION THE STATE OF MINNESOTA THERE WILL BE THREE BRANCHES OF GOVERNMENT. HOUSE; THE SENATE THE GOVERNOR AND THE JUDICIARY. JUST LIKE THE HOUSE AND SENATE HERE ARE CONTROLLED BY ONE POLITICAL PARTY THE FIVE COMMISSIONERS THAT A BIT OF POINT APPOINTED BY THE PARTIES GOVERNOR. UNDERSTAND THAT’S AN IRRITANT BUT WE HAVE TO LIVE WITH THIS IF WE HAVE A CIVIL SOCIETY WE CAN PICK AND CHOOSE THE RESULTS OF THE ELECTION. PEOPLE HAVE ALREADY POINTED OUT THERE’S ABOUT FIVE MAIN FACTORS THAT ARE INVOLVED IN THIS CERTIFICATE OF NEED AND ROUTING IN THE DECISION BY THE PUBLIC UTILITIES COMMISSION ON THE CERTIFICATE OF NEED THERE’S ALL KINDS OF SUBPOINTS UNDERNEATH THEM I AGREE WITH THE PREVIOUS TESTIFIER THAT THE MINISTRY OF LAW JUDGE AND THE COMMISSION MUST NOW WEIGH SUCH IMPORTANT FACTS AS THE ENERGY INFORMATION ADMINISTRATIVE DATA DEMAND FOR FINISH TROLLING PRODUCTS OF MINNESOTA IS DOWN 19% SINCE 2004. THEY MUST WEIGH THE EFFECTS OF THE EMERGING ELECTRIC CARS ELECTRIFICATION OF TRANSPORTATION. BY THE WAY; AMERICANS CONSUME LESS GASOLINE IN 2017 THAN THEY DID IN THE PREVIOUS YEAR ACCORDING TO REUTERS. THE COMMISSION MUST CONSIDER HOW MUCH OIL GOING FOR EXPORT IN THE FORM OF FINISHED PRODUCT. THE UNITED STATES IS NOW AN EXPORT OF FINISHED PETROLEUM PRODUCTS. THEY MUST DECIDE WHETHER THE NET JOBS PREPARING LINE 3; OLD-LINE THREE; VERSUS B WILL BE EMPLOYED TO MAINTAIN IT A NEW PIPELINEA WITH THE IMPACT.. WHETHER THE POTENTIAL DESTRUCTION OF STATE WILD RICE BEDS AND THE IMPACT OF THE DESCENDENTS; THE IMPEDIMENT DESCENDENTS OF THE ORIGINAL PEOPLE OF THIS LAND AND ANIMAL HABITAT ARE MORE OR LESS IMPACTFUL THE PROFIT OF THE INDUSTRY. IT MUST WAIT WHETHER INCREASING CARBON ADMISSIONS TO INCREASES IN ELECTRICITY AND [INAUDIBLE] A PROCESS OF PROCESSING TAR SANDS OIL ARE IMPORTANT OR NOT. I ASK YOU TO VOTE; NO COME ON HOUSE FILE 3759 AND I REMEMBER THOSE THAT SPEAK OUT AGAINST POWER IN ORDER TO BRING CHANGE TO OUR SOCIETY. I ASK YOU TO VOTE TO ALLOW THE PROCESS THAT’S CURRENTLY IN PLACE TO CONTINUE. MINNESOTA 350 IS A SUSTAINABLE JUST FUTURE AND SAVE CLIMATE FOR US ALL. THANK YOU.SPEAK>>CHAIR GAROFALO: THANK YOU FOR YOUR TESTIMONY. DON GOODWIN. DON GOODWIN? WELCOME TO THE COMMITTEE STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: MY NAME IS NANCY-ITEM AND I’M A MEMBER OF THE LAKE RESERVATION AND I’M ALSO IN WITH AN ORGANIZER FOR MINNESOTA 350. I COME HERE TODAY BECAUSE I WAS GIVEN THE OPPORTUNITY AND I THANK YOU FOR THAT-TO URGE YOU GUYS TO MOVE FORWARD HOUSE FILE 3759. I HAVE HAD SOME OPPORTUNITY TO REVIEW EIS IN REGARDS TO MY TRIBE AND SIMILAR TRIBES AS WELL THAT ARE INVOLVED IN THIS. REALLY BROKE MY HEART WAS THE DISREGARD AMBRIDGE HAS FOR TREATY IN THAT EIS. BUT PUBLICLY AND COMMERCIALS AND IN NEWSPAPERS THEY TELL US THEY WORK WITH OUR COMMUNITIES AND THAT BREAKS MY SPIRIT. BECAUSE I AM A REAL PERSON I AM A PART OF THE COMMUNITY. I WASN’T I WAS IN DULUTH WHEN IT ISOLATED TOOK PLACE. WE COME IN A GOOD WAY WE DO HAVE ISOLATED INSTANCES IT SHOULD BE TREATED AS SUCH. WE ARE STIGMATIZED AS PROTESTERS BUT ACTUALLY WE’RE HERE TO DEMONSTRATE OUR VALUE FOR LIFE. SO; YOU KNOW; WHAT BOTHERS ME THE MOST IT WAS NEVER AN EIS BY THE FRONT OF THE HEADWATERS. [INAUDIBLE] WORKED HARD AND MADE AS POSSIBLE PRIOR TO THAT NEVER TOOK PLACE. SO; BECAUSE THE NATIVE PEOPLE OF THE FORGOTTEN PEOPLE ARE TREATIES ARE JUST DISREGARDED. [INAUDIBLE] WELL WE’RE STILL HERE. WE ARE EDUCATED. WE HAVE MORALS. WE ARE FAMILIES. WE HAVE OUR [INAUDIBLE]. SO WHITE MAYBE ALL THIS HAPPENS IS BECAUSE PEOPLE ARE NOT ON THE TABLE SO BASICALLY I GOT INVOLVED BY ATTENDING THE [INAUDIBLE]. I BECAME A DELEGATE AND THEN I MARCH 4 I TENDED OUR [INAUDIBLE] CONVENTION AND WENT ON TO BE AN ALTERNATE PRIOR TO THAT PRECINCT CAUCUS A LOT OF RECOGNITION[INAUDIBLE] OF FRONTLINE AND INVOLVES TREATY RIGHTS. IT’S ON THE SLATE FOR THE CONGRESSIONAL DISTRICT CONVENTION TO VOTE ON APRIL 1. I FEEL THAT WE HA D THE [INAUDIBLE] BACK THE TABLE BECAUSE WHEN YOU DON’T OUR ECONOMY IS DISREGARDED BY COMPANIES BY LIKE AMBRIDGE. IT THREATENS OUR CULTURE AND WELL-BEING. I JUST WANT TO SAY THAT I WANT TO MAKE SURE THAT WE ARE AT THE TABLE AND INCLUDED AND I THINK HE EIS AT AMBRIDGE HAS MINNESOTA PUC HAS [INAUDIBLE]. IT DOESN’T INVOLVE US THE WAY IT NEEDS TO. SO TODAY I GOT A LITTLE OPPORTUNITY TO TALK ABOUT IT AND I’M GOING TO DO THAT. SO; I WANT TO KNOW-I WANT YOU GUYS TO KNOW THAT IN NORTHERN MINNESOTA THE REASON WHY I AM THERE [INAUDIBLE] PREVIOUSLY OPEN OFFICE BECAUSE THERE IS OPPOSITION OF NORTH. WE KNOW THERE’S A LITTLE BIT JOBS GOING TO BE 20 LIES THE PIPELINE GOES THROUGH AS A NATIVE AMERICAN COMMUNITY WE HAVE MURDERED INDIGENOUS WOMEN AND IS A CORRELATION. SO WHEN’S MEN COME INTO OUR TOWN TO DO THE PROJECTS THAT MR. FABIAN MENTIONED EARLIER; ARE PEOPLE HAVE ISSUES THAT MOST PEOPLE DON’T WANT TO TALK ABOUT. SO I THINK IT WAS IMPORTANT THAT WE ARE INCLUDED. IT CEDED TERRITORY. WE ARE AUTONOMOUS [INAUDIBLE] WE HAVE BEEN SICK THE ADVERTISERS NATIVE AMERICAN ACTIVISTS BUT [INAUDIBLE]WE ARE EVERYTHING BUT THAT. SO I ASK AMBRIDGE NOT TO DO THIS TO US [INAUDIBLE] NATIVE AMERICAN COMMITTEE’S WE ALREADY KNOW THAT THE PUC LEVEL LEFT US OUT. RUSHING THIS BILL TODAY DOES THE SAME THING. SO I THINK I WAS GIVEN OPPORTUNITY TO SPEAK. THAT IS MY FIRST AMENDMENT RIGHT. BUT WITH THESE AND SIMILAR REPRESENTATIVES PUSH THESE BILLS AND HINDER MY FIRST AMENDMENT YOU ALL HEARD THE PUC WE WENT TO HEARINGS THAN THEY DID THIS. OUR VOICES ARE NOTHING [INAUDIBLE]. I AM HERE TO STAND FOR MY PEOPLE; OUR TREATIES; 2020 [INAUDIBLE] I’M NEW TO THIS BUT WE ARE LEARNING. WE HAVE DELEGATES. WE HAVE NON-NATIVE RELATIVES. THEY ARE WITH US NOW. WE ARE GOOD PEOPLE. I FEEL [INAUDIBLE] EXCLUDED NATIVE AMERICAN PEOPLE [INAUDIBLE] SOMETHING OF THE PAST BUT I ASK YOU GUYS; PLEASE; CONSIDER INCLUDING US AND MAKE A BETTER FUTURE. WE KNOW THERE’S ENERGY IN TRADE A LOT OF JOBS BUT [INAUDIBLE] DON’T NEED THAT OIL. IT’S CALLED TRANSITION AND [INAUDIBLE] WE ARE GOING TO WORK ON IT. I URGE YOU GUYS TO OPPOSE HOUSE FILE 3759 AND LET IT FOLLOW THE PROCESSES THAT WERE PUT FORTH TO PROTECT PEOPLE LIKE YOU AND PEOPLE THAT ARE HERE REGARDLESS OF THEIR CULTURE AND THEIR RACE. WE ONLY THAT WATER. SO I THINK YOU FOR YOUR TIME AND I URGE YOU GUYS TO OPPOSE HOUSE FILE 3759.>>CHAIR GAROFALO: THANK YOU FOR YOUR TESTIMONY. ALEX MADDEN. AS ALAN HAD A CHANCE TO TESTIFY TO SET UP ON THE TESTIFIER LIST? SO THIS WILL BE THE FINAL –[INAUDIBLE] I HAVE THREE PEOPLE ON THE LIST THAT SIGN UP IN ADVANCE AND FIVE WHO SIGNED UP ON THIS LIST. WELCOME TO THE COMMITTEE. STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: BEFORE AND DON GOODWIN IS MY ENGLISH NAME. [NON-ENGLISH SPEAKER] I’M FROM THE WHITE EARTH NATION. A MEMBER OF THE MINNESOTA CHIPPEWA TRIBE AND HIM FROM THE [INAUDIBLE] I COME HERE TODAY TO URGE YOU TO VOTE AGAINST THIS HF 3759. I BROUGHT SOME THINGS WITH ME TODAY SOME TEACHING. WHEN YOU TALK ABOUT THINGS OF NATURE THEY NEED TO BE PRESENT ALSO AND THAT’S WHY I HAVE THIS BASKET HERE TODAY. I HAVE WILD RICE FROM THE VERY LAKE I LIVE NEXT TO WHICH WAS HAND HARVESTED BY MY FAMILY MEMBERS I HAVE CEDAR; SAGE; SWEETGRASS AND LABRADOR TEA THAT IS COLLECTED NEAR THE PROPOSED ROUTES. I COME FROM THIS AREA I LIVE IN BAGLEY MINNESOTA I ALSO HAVE WATER HERE FROM A FLOWING SPRING JUST OFF LO WER PRICE LAKE WHICH IS CONNECTED TO UPPER RICE LAKE WHICH IS RIGHT NEXT TO THE PROPOSED IMAGES PROPOSED RIGHT. THE PREFERRED ROUTE. AS YOU SEE; I AM THE ONLY ONE FROM MY COMMUNITY HERE TODAY. THIS IS VERY VERY IMPORTANT TO ME. I NEED YOU TO UNDERSTAND HOW IMPORTANT IT IS THAT I CAME HERE.. THE ONLY ONE FOR MY COMMUNITY. BECAUSE I HOLD THIS DEAR WITH WHAT I’VE BEEN RAISED AND TAUGHT ALL MY LIFE. I WENT ON WITH A LIFE AFTER I TURN 18 WENT TO COLLEGE LIKE I WAS EXPECTED TO AND I WANTED TO DO THAT. TO BETTER MY LIFE. I WAS EVERY MAJOR YOU COULD THINK OF YOU I STARTED OFF IN ARTS. THAT’S WHERE MY HEART WAS. I WAS ALWAYS STEERED AWAY FROM THAT BECAUSE OUR DEGREES ARE NOT EASY TO COME BY JOBS. ESPECIALLY IN THE NORTHERN MINNESOTA. SO I WAS STEERED AWAY FROM THAT. THEN I WENT TO POLITICAL SCIENCE.. I LEFT THAT WAS NOT WHERE MY HEA RT WAS. ALTHOUGH THE INTEREST WAS THERE .. I WENT ON TO MASS COMMUNICATIONS THAT WASN’T FOR ME. I DO NOT LIKE TO GET UP AND SPEAK SPEAK IN FRONT OF PEOPLE LIKE I AM TODAY. THEN I WENT ON TO ENGLISH. ALL THESE THINGS INTERESTED ME. THEN I REALIZE; YOU HAVE TO TAKE A FULL SEMESTER OF SHAKESPEARE. NO. NOT A CHANCE. I WAS NOT GOING TO BE AN ENGLISH MAJOR AT THAT POINT. SO I CONTINUED ON TAKING THE CLASSES I WAS REQUIRED AND TAKING CLASSES THAT WERE OF INTEREST TO ME. WHERE MY HEART WAS. AS I WAS GOING THROUGH AND LOOK AT MY-FILLING OUT STUFF FOR THE GRAD PLANS AND FIGURE OUT WHAT I HAD TO FINISH TAKING EVERYTHING LINED UP FOR VISUAL ARTS AND NATIVE STUDIES. SO I CONTINUED TO FINISH THOSE -FINISH THAT UP AT BEMIDJI STATE UNIVERSITY AND I GOT MY VISUAL ARTS DEGREE. I WAS ONE RESEARCH PAPER AWAY FROM GETTING MY DEGREE SIGNED AND NATIVE AMERICAN STUDIES AND DURING THAT TIME THE QUESTION WAS; FOR MY RESEARCH PAPER; IS HU FEELING? SO I STARTED TO WRITE IT. I THOUGHT THAT I COULD WRITE THIS FLUFFY RESEARCH PAPER JUST TO GET IT DONE I WAS LIKE; OKAY; IT’S POINTING TO OUR SYSTEM AND OUR SYSTEMS ARE BROKEN. A T THE GOVERNMENT LEVEL ALSO. NOT ONLY AT THE SCHOOL SYSTEM LEVEL. OF COURSE; EVERYBODY HAS A PIECE OF THAT PUZZLE AND THE STUDENT HAS THEIR INPUT AND FAMILIES HAVE THEIR INPUT. SO WE ALL HAVE TO WORK TOGETHER BUT WHAT I REALIZED AT THAT POINT WAS HOW MUCH OUR ENVIRONMENT WAS CONNECTED TO HER EDUCATION SYSTEM AND WHAT WE WERE TEACHING OUR CHILDREN WAS JUST TO CARRY ON WITH LIF E; CLIMB THE CORPORATE LADDER AND MAKE ALL THE MONEY YOU CAN TO B E SUCCESSFUL AND HAVE STATUS NEEDLESS TO SAY I NEVER FINISH THAT RESEARCH PAPER BECAUSE I COULD NOT CALL PEOPLE OUT. I’M A NICE PERSON. I DIDN’T WANT TO CALL PEOPLE OUT AND SAY WHAT’S YOUR PROBLEM;; IT’S YOUR FAULT. SO I LET IT GO. AT THAT TIME MY INTEREST WAS PIQUED AND I STARTED LEARNING ABOUT [INAUDIBLE] OIL AND–I NEVER HEARD ABOUT IT SO I STARTED STUDYING THAT. I URGE YOU TO STUDY WHAT IS TAR SANDS OIL. CANADA AN IMAGE DO NOT LIKE IT TO BE CALLED TAR SANDS OIL THEY PREFER BY TWO MEN WERE [INAUDIBLE] OR OIL SAND. SO I COME TO THIS AND I HAVE READ THEN I READ THE EIS WHAT STOOD OUT TO ME BECAUSE ALSO I’M INTERESTED OF COURSE THE ENVIRONMENTS. LIKE I SAID I WAS INTERESTED IN ALL KINDS OF THINGS. WHAT STUCK OUT TO ME WAS IN CHAPTER 10 . 2.1 BUT THERE IS LITTLE RESEARCH OF THE TOXICITY OF [INAUDIBLE] ON ORGANISMS. SO THAT REALLY WORRIES ME THIS IS A STUDY THAT WAS PUT OUT BY THE NATIONAL ACADEMY OF SCIENCE. WHEN I’M GOING TO REFERENCE HERE. I THINK YOU NEED TO KNOW WHAT IS IN OIL SAND SO I’M GOING TO READ JUST A LITTLE BLURB HERE. MINOT MEN WILD RICE IS A CULTURALLY-CULTURAL HIGHLY PRIZED SUPER RESOURCE FOR THESE [INAUDIBLE] THIS AN IMPORTANT RESOURCE FOR BIRDS AND OTHER ANIMALS ALSO. IT IS AN ORGANIC RAIN THAT GROWS NATURALLY OUT OF WATER AND HAS BEEN NAMED MINNESOTA’S STATE GRAIN. MINOT MEN IS RIGHT UP ON HIGH WATER QUALITY; HENCE THE 1973 SULFITE STANDARD. ESTABLISHED AND PUT IN PLACE. THE POSSIBILITY OF DILUTED BY TWO MEN ENTERING TH E WATERWAYS [INAUDIBLE] WITH AGGREGATE 108 AND BE CATASTROPHIC FOR WILD RICE BANDS. [INAUDIBLE] CONTAINS VOLATILE ORGANIC COMPOUNDS POLYCYCLIC HYDROCARBONS MONO AROMATIC HYDROCARBONS. HYDROGEN SULFIDE TOXIC METALS AND OTHER UNCHARACTERIZED MICHAEL’S. THESE HYDROCARBONS [INAUDIBLE] OR SOLUBLE ONES SUCH AS BENZENE ETHYLBENZENE; [INAUDIBLE] ARE KNOWN CARCINOGENS THAT MOVE EASILY INTO SERVICE WATERS AND AQUIFERS. OIL AND WATER SPREADS INSTANTANEOUSLY WHICH INCREASE THE NEGATIVE FOOTPRINTS ON THE ENVIRONMENT. IN ADDITION; INCREASING SUNLIGHT EXPOSURE ON THE WEATHERED BITUMEN INCREASES TOXICITY. THEREFORE RESENTING A HAVE ABSURD TO AQUATIC LIFE. FURTHERMORE; THESE ARE THE GREATER VOLUME OF RESINS THAN [INAUDIBLE] PRESENT IN BITUMEN IS RESIDUE BECOMES ADHESIVE AND IS NONBIODEGRADABLE. WITH ADHESIVE PROPERTY INTO THE CLEANUP BECAUSE IT STICKS TO ROCK VEGETATION AND ANIMALS. THE BY TWO MEN ALSO SINKS INTO WATER. PROLONGED EXPOSURE TO SUNKEN AND STICKY BITUMEN IS TALK EXPOSURE TO PEOPLE PLANTS AND WILDLIFE. WETLANDS ARE IMPORTANT ECOSYSTEMS THAT ARE PROTECTED AND SHOULD REMAIN SO IN THE EVENT OF A SPILL WEATHER BY TWO MEN CONTAINS A LARGE AMOUNT OF RESIDUAL OIL THAT BECOMES HIGHLY ADHESIVE WHEN ABSENCE OF DELUSIONS. THAT EVAPORATES MAKES IT MORE DIFFICULT TO CLEAN UP THIS RESIDUAL TOXIC TOXICITY – EXCUSE ME – TOXICITY SUBSTANCE WILL BE IMPOSSIBLE TO CLEAN AND ENTIRETY ESPECIALLY IN REMOTE HARD-TO-REACH WETLAND AREAS THAT CONTAIN AQUATIC LIFE THAT ARE CULTURALLY SIGNIFICANT. THE CERTIFICATE OF NEED- AND THIS CANNOT BE GRANTED BY THE PUC-AND I URGE YOU TO OPPOSE AND VOTE THIS DOWN. 3759. I COME FROM THIS COMMUNITY. THIS PROPOSAL ROUTE IS RIGHT IN MY COMMUNITY. THIS IS WHERE I GO TO EXERCISE BY TREATY RIGHTS BECAUSE THERE ISN’T MUCH PLACE TO GO ON A RESERVATION. WE ONLY OWN 12% OF OUR RESERVATION AND PART OF THAT 12% IS MARSHLAND AND WETLANDS. SO WE NEED TO GO OUT OF OUR RESERVATION BOUNDARIES TO LIVE A SUSTAINABLE LIFE. THIS IS PART OF MY LIFE. THIS IS HOW WE LIVE. I PICKED THAT PIECE; CLICK THAT WATER I DRINK THAT WATER. OUR COMMUNITY DEPENDS ON THAT WATER. WHEN THE STORMS CAME THROUGH RETURN COMMUNITY GO? THEY WENT TO THE WELLS TO GET WATER. JUST ON THE OTHER SIDE OF THE LAKE. AND DOWN THE ROAD FROM ME. THAT COULD BE IN DANGER. YOU ARE JUST TAKING A RISK THAT PIPELINE WOULD CROSS WETLANDS; RIVERS; TRIBUTARIES I WANT YOU TO LOOK AT THE MAP THAT WAS GIVEN. I DIDN’T BRING IT UP BUT YOU CAN SEE THERE’S BOUNDARIES OF THE RESERVATION AND ON THE RIGHT SIDE OF THE BOUNDARY IT’S CHOPPED OFF CONVENIENTLY; RIGHT NOW WHICH IS FAILING [INAUDIBLE] THAT’S DISPUTED TOWNSHIPS AND I WILL MENTION SOMETHING HERE. THOSE DISPUTED TOWNSHIPS ARE FEDERALLY RECOGNIZED. YOU CANNOT CHANGE THE BOUNDARIES OF A RESERVATION. THOSE ARE FEDERAL BOUNDARIES. WE DO HAVE-THAT’S WHERE THE PROPOSED ROUTE WOULD GO RIGHT ON THE CORNER OF OUR RESERVATION. THEN; RIGHT NEXT TO IT AND THE WATER COMES TO US; FLOWS ONTO OUR RESERVATION. THAT WE NEED TO THINK ABOUT WHY TO HAVE THAT 1855 TREATY. WHY? WHY DO WE HAVE THAT? YOU NEED TO ASK YOURSELVES THAT YOU NEED TO LOOK AT THAT STATE FLAG BACK THERE WITH A FARMER WITH A PLOW HAND PLOW AND A NATIVE YOU WERE LIVING SIDE-BY-SIDE HOW CAN WE CONTINUE TO LIV E SIDE-BY-SIDE? THAT’S WHAT THE 1855 TREATY IS ABOUT. THAT WE CAN LIVE SIDE-BY-SIDE AND THAT WE AGREED THAT YOU COULD COME AND LIVE IN THAT WE WOULD LIVE PEACEFULLY BUT WE DID NOT EXPECT BITUMEN AND TA R SANDS PIPELINE TO BE SHUT DOWN OUR THROATS. RIGHT TO THE HEART OF OUR 1855 TREATY AREAAND THEN [INAUDIBLE] ABANDON. THEN [INAUDIBLE] LAKE AMPERAGE WANTS TO PLAY WITH WORDS BUT IT’S ON REPLACEMENT PIPELINE PER SE. IT’S A REPLACEMENT AND A RELOCATION SO I THOUGHT A LOT OF PEOPLE THAT ARE SO IN SUPPORT OF THIS ARE COMPLACENT AND THEY DON’T UNDERSTAND ALL OF THIS .. IT’S HARD TO UNDERSTAND ALL OF THIS. THERE’S SO MUCH MORE TO THIS. I COULD GO ON AND ON AND ON. SO I’M GOING TO MENTION THIS CFR THE DAKOTA FEDERAL REGULATION; 42 IT’S THE WHITE EARTH FROM CHEMICAL CODE. IT’S A UNIQU E MOU AND WE ARE THE ONLY ONE IN REGION FIVE THAT HAS THIS AT OF MINNESOTA WISCONSIN INDIANA OHIO AND MICHIGAN. THAT WE HAVE THE SOLE AUTHORITY OVER STATE TO REGULATE SALES; TRANSPORTATION AND APPLICATION OF CHEMICALS AS OPPRESSED BY THE NATURE REGISTERED OR UNREGISTERED ACROSS THE BORDER WERE OUR BOUNDARIES. SO THE CURRENT REFERRED ROUTE THAT SLICES OUR RESERVATION BOUNDARY FEDERALLY RECOGNIZED AND RIGHT NOW IT’S CONVENIENTLY LEFT OFF THE MAP AND IT’S OBVIOUS. YOU CAN SEE IT IF YOU LOOK AT YOUR LITTLE MAP THERE. STILL IN DISPUTE. SO WE ASSERT OUR TREATY RIGHTS ESPECIALLY OUR WATER RIGHTS BECAUSE ALL THAT WATER IS FLOWING TOWARDS US. IN THE WHOLE REGION THE WATER FLOWS IN EVERY DIRECTION. SOUTH AND EAST; NORTH AND WEST.. THE BULK OF THIS PIPELINE GOES TO CLEAR BOOK WHICH IS IN PURE WATER COUNTY WE NAME D IT CLEARWATER COUNTY FOR A REASON AND WE WANT TO KEEP IT THAT WAY. SO LIKE I SAID I COULD GO ON AND ON. MY NAME THAT I GOT HIS EVERLASTING WIND AND LIKE I SAID I DIDN’T WANT TO GET UP IN FRONT OF PEOPLE AND TALK A ND DO WHAT I’M DOING NOW BUT I HAVE TO I WANT TO BE DOING MY ARTWORK HAVE MY LITTLE PAINTER HAT AND NOT WHAT NOT AND PAINT WAY AND LEARN MY LANGUAGE. BUT I’VE BEEN TRYING TO L EARN BECAUSE FOR SOME REASON IT WAS A DISCONNECT AND I DO NOT LEARN THAT LANGUAGE. WE WON’T GO INTO THAT RIGHT NOW. BUT IT’S VERY IMPORTANT FOR ME TO COME BECAUSE THIS IS MY COMMUNITY. THESE ARE MY PEOPLE AND I’M NOT THE ONLY ONE THAT GOES IN THIS AREA. WE KNOW THERE ARE THREE PIPELINES; MAYBE TWO OF WHAT I UNDERSTAND WHICH [INAUDIBLE] WE KNOW THEY ARE THERE. WE KNOW THERE ARE RISKS ALREADY THERE. WHAT I UNDERSTAND IS CRUDE; SWEET CRUDE; BUT NOW ANYBODY LOOK AT THOSE OLD PIPELINES THAT ARE IN THERE. THEY ARE GOING TO NEED SOME REPAIR; TOO. SO IS THAT RIGHT TO PUT A PIPELINE IN SOMEWHERE ELSE AND YOU DON’T EVEN KNOW WHAT TO DO WITH THE OLD ONES THAT ARE IN THERE ALREADY? YOU REALLY DON’T KNOW. ALSO; THERE IS VERY LITTLE INFORMATION OR TECHNOLOGY; THERE’S LITTLE TECHNOLOGY TO CLEAN UP TAR SANDS OIL. ALL I HAVE IS THESE LITTLE THEY CALL THEM DIAPERS THAT SOAK UP THE TOP LAYER OF STUFF BUT LIKE I SAID; TAR SANDS SINKS INTO WATER. FROM WHAT I’VE LEARNED ABOUT WATER QUALITY THESE RIVERS HAVE INCREASED TURBIDITY IN THEM. WITH INCREASED TURBIDITY THAT TAR SANDS IS GOING TO STICK TO THE TURBULENT ITEMS THAT WATER. SO THERE’S A LOT HERE AT STAKE . OF SO WE WERE AT THE TABLE OF AMBRIDGE AND WHITE EARTH. JUST ABOUT A YEAR AGO IN MARCH. AND THEY SAID; WE WILL GO AROUND YOUR UPPER RIGHT PLANE. WILL BUILD A LITTLE ELBOW AND GO AROUND YOUR LAKE AND THEN I’VE BEEN SO THEN YOU GUYS WILL BE HAPPY. WELL; WE KNOW THAT ELBOWS; THOSE ARE AREAS OF WEAKNESS SO YOU WILL BUILD SOMETHING AROUND THIS LAKE AND HAS MORE POTENTIAL FOR WEAKNESS BUT YET IT SUPPOSED TO MAKE ME FEEL BETTER? I’VE BEEN GIVEN PERMISSION TO SPEAK FOR OUR ELDERS AND THEY WROTE A RESOLUTION AND WE’VE SUBMITTED THAT TO THE PUC I’VE BEEN TO MANY PUC MEETINGS GIVING TESTIMONY OVER MANY YEARS INCLUDING THE SANDPIPER SO I URGE YOU TO THINK ABOUT ALL THESE THINGS. I GATHER ACROSS THE PIIPELINES THAT ARE THERE ALREADY AND GO AND PICK MY BERRIES I GO SIT MY PLACE OF SOLITUDE; PICK MEDICINES. ALL IN THIS AREA. BECAUSE IT’S CLOSE TO HOME. IT’S RIGHT NEXT DOOR. THERE IS MUCH PRIVATE LAND ALL THE WAY AROUND ME IN VERY LITTLE BIT OF IT IS OWNED BY A RESERVATION. SO I URGE YOU TO PASS THIS BILL. I ALSO SPEAK FOR TRADITIONAL PEOPLE BECAUSE WE KNOW THE VALUE OF THIS. ASK MY FRIEND; WHAT CAN YOU SAY ABOUT-WHAT YOU WANT TO SAY. HE SAID; TELL THEM I HAVE $1000 IN MY POCKET BUT IF I DON’T HAVE BLUEBERRIES AND SAGE PEAS AND WILD RICE I FEEL LIKE THE POOREST PERSON EVER. I SAID I UNDERSTAND THAT BECAUSE THERE’S SOMETHING TO BE SAID ABOUT GATHERING WITH YOURSELF . THAT IMPACTED ME WHEN SHE SAID THAT. SHE SAID I COULD EVER THOUSAND DOLLARS IN MY POCKET BECAUSE SHE COULD PROBABLY GO OUT AND BUY SOME BLUEBERRIES AND MAYBE WATER IN THIS PEAS AND PEOPLE EVEN SELL SAGE . THEY’RE NOT ENCOURAGED TO DO SO. SHE COULD GO BY THOSE THINGS BUT IF YOU DON’T GO AND COLLECT THOSE YOURSELF IT’S NOT THE SAME. I TOLD MY MOTHER SEVERAL YEARS BACK; THIS WAS AFTER THE SANDPIPER THROUGH ALL THIS; LEARNING ALL THE STUFF; I SAID; MOM; I FINALLY FIGURED OUT WHAT I WANT TO BE WHEN I GROW UP. I WANT TO BE A [INAUDIBLE]. SHE LOOKED AT ME AND SURPRISED SHE COULDN’T SMILE AT FIRST BECAUSE OH; MY DAUGHTER KNOWS WHAT SHE WANTS TO BE WHEN SHE GROWS UP. WELL I AM 46. SO NOW I JUST WANT TO BE IN THE SHOULD NOT BE. I WANT TO BE ABLE TO GO THERE I WANT TO BE ABLE TO BEHIND ME THE YOUNG PEOPLE TO DISCOVER WHO THEY REALLY ARE THIS IS WHO I AM. I UNDERSTAND; YES I DO USE OIL. I USE GAS BUT I’M TRYING TO CHANGE MY LIFE TO IT MAKES ME FEEL GOOD. TO GO AND GATHER MY MEDICINES TO BE ABLE TO GET MY OWN WATER. BRING WATER TO MY FAMILY. TO GO AND HARVEST THIS RICE. I CAN DO THIS AND I WILL CONTINUE TO DO SO BUT I WANT TO ENSURE THAT THE NEXT GENERATION;; THE NEXT SEVEN GENERATIONS; CAN DO THIS ALSO. SO I’M GONNA LEAVE YOU WITH THAT THANK YOU FOR THE OPPORTUNITY TO SPEAK ..>>CHAIR GAROFALO: SPEAKERS SPEAKERSWELCOME TO THE COMMITTEE STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: MY NAME IS ALICE MARTIN. THANK YOU FOR THE OPPORTUNITY TO SPEAK. WHAT YOU ARE ABLE TO WITNESS TODAY IS A VERY VERY VERY SMALL SLIVER OF THE TIME PEOPLE ARE PUT INTO THE PUC PROCESS. PLEASE; RESPECT THAT PROCESS. IT WAS SET UP FOR A REASON. I FEEL VERY MUCH WHAT YOU SAID REPRESENTATIVE FABIAN BUT THE REPRESENTATIVE FROM RURAL COMMITTEES AND PUC. I THINK THERE’S A LOT OF ISSUES ABOUT BEING ABLE TO PUT ADEQUATE INPUT INTO THESE PROCESSES FOR ROW FOLKS WHO DON’T LIVE SO CLOSE TO THE CAPITAL. I CAN ALSO TELL YOU IT’S HUGE TIME FOR THOSE WHO EVEN TO LIVE NEXT CLOSE TO THE CAPITAL. I THINK IS A GENE RAL SUGGESTION HAVING SOME KIND OF USE OF TECHNOLOGY LIKE BEING TO SKY PEOPLE FROM FAR AWAY WOULD BE A GOOD USE OF RESOURCES TO HAVE A MORE DIVERSE AMOUNT OF PEOPLE TO COME IN AND SHARE THEIR OPINION. SO; MY GENERAL POSITION IS THAT I HOPE YOU OPPOSE TH IS BILL. I JUST CAME FROM A SENATE HEARING COMMITTEE HEARING OVER ON THE OTHER BUILDING WITH MORE OR LESS THE SAME DYNAMIC WHERE A MASSIVELY POWERFUL ENERGY COMPANY IS ASKING TO MONOPOLIZE CHOICES ; DECISIONS WHAT IS AFFORDABLE WHAT IS RELIABLE WITH THE GOOD DECISIONS FOR COMMUNITIES AND WHERE WE ARE GETTING OUR JOBS FROM. NO O NE IN THIS ENTIRE ROOM WOULD SAY WE DON’T NEED JOBS EXCEPT MAYBE ROBOT TECHNICIANS. I DON’T KNOW. WE NEED JOBS. WE SHOULD BE ABLE TO DECIDE WHAT THOSE JOBS ARE. WE CANNOT ALLOW POWERFUL COMPANIES TO COME IN FROM OTHER COUNTRIES; OTHER STATES TO DECIDE WHAT THOSE JOBS WILL BE AND WHO GETS THOSE JOBS. I THINK WHAT YOU’RE WITNESSING YOUR TODAY IS A PLACE WHERE THEY HAVE [INAUDIBLE] OUR COMMITTEES WE ARE BEGGING FOR JOBS FR OM A COMPANY WHO DOESN’T CARE ANYTHING ABOUT THE LONG-TERM SUCCESS OF OUR COMMUNITIES. [INAUDIBLE] FAST-TRACK IN VARIOUS OTHER PLANS-THIS IS AMPERAGE BUT ALSO EXCEL ENERGY FAST TRACKING PLANS FOR NATURAL GAS FOR NUCLEAR WHICH WHEN YOU THINK ABOUT YOU WANT TO LIVE NEXT TO A PLANT LIKE THAT I’M NOT SURE MANY PEOPLE WOULD SAY THEY DO. IT’S OFTEN WHERE THEY GET [INAUDIBLE] THAT’S WHY THEY GET PUT ON TRIBAL LAND AND THAT’S A CONSEQUENCE IS THAT NO ONE SEES THE PEOPLE VERY MUCH EXPERIENCE. YOU ARE HERE REPRESENTING MINNESOTA BUT I WOULD ALSO SAY YOU HOLD IN YOUR HANDS THE PIECE OF LEGISLATION THAT IMPACTS PEOPLE ALL OVER THE WORLD. YOU HAVE AN ENORMOUS PRIVILEGE AND ENORMOUS PRIVILEGE. SOF OR THE REMAINING PARTS OF MY COMES I LIKE TO ADDRESS TO YOU I REALLY APPRECIATE YOU BRINGING FORTH A BILL THE INTENTION YOU DID THAT THIS IS SOMETHING WHERE YOU ARE UNSURE WHAT ELSE YOU CAN DO FOR CONSTITUENTS. WHAT DID YOU–IF YOU’RE WONDERING WHAT ARE YOU CAN ESSAY TO THE CONSTITUENTS WHEN YOU GO BACK TO THEM IF THIS BILL DOES NOT PASS; IT’S NOT APPROVED BY THE PUC. I SHARE VERY MUCH THAT FEELING WHEN I THINK A LOT OF PEOPLE KNOW WHAT AM I GOING TO DO AND THAT’S WHEN YOU SEE PEOPLE OUT AT STANDING ROCK AND THAT’S WHY PEOPLE SEE PEOPLE PROTESTING WHICH IS SHARING THEIR OPINIONS AND DOESN’T LOOK LIKE THEY COME IN A SUIT AND TIE 11 REGISTERED LOBBYISTS. THEY ARE SHARING THEIR OPINION AND THE ONLY WAY THEY KNOW HOW AND I SEE THIS BILL IS EXACTLY THAT. THE ONLY WAY WE KNOW HOW TO BE ABLE TO FIND JOBS IN A COMMUNITY WHICH I THINK IS AGAIN NO ONE CAN DISPUTE WE NEED JOBS WHAT I THINK THE MOST RESPONSIBLE ETHICAL AND LONG-TERM LIKE LONG CITED POSITION THAT I WOULD REALLY ASK YOU TO CONSIDER IS TO TA KE BACK THIS BILL; TAKE IT OUT OF CONSIDERATION AND GO BACK AND SPEND TIME WITH HER COMMITTEE SAYING THIS IS GOING TO BE REALLY HARD THIS IS GOING TO BE A PROCESS FULL OF GRIEF; FULL OF NEW CHALLENGES NEWS GOES BUT THERE IS IN THE [INAUDIBLE] AND SO WE NEED TO PUT FORTH A BILL TO SAY I WANT TO HOLD OUT THAT HOPE FOR LONGER THAT WE CAN CONTINUE TO HAVE THIS KIND OF INFRASTRUCTURE IS ALIVE. I THINK IT’S GOING TO BE REALLY HARD TO COME BACK TO YOU TO PROCESS THAT WITH YOUR COMMUNITY BUT I THINK IT’S REALLY NECESSARY AND IT’S THE MOST HONEST AND MOST FORWARD THINKING AND LONG-TERM-I THINK THAT’S THE-I GUESS THAT CODE ABOUT LOVE BEING MUCH MORE DREADFUL THAN IN DREAMS. THAT’S WHAT LOVING YOUR COMMUNITY IS. THERE IS NO FUTURE IN THIS. WE HAVE TO DO SOMETHING DIFFERENT WE GET TO DECIDE WHAT THAT IS [INAUDIBLE] OR ANY OTHER COMPANY. THE UNIONS ARE REPRESENTING JOBS. NOT REPRESENTING AN INDUSTRY. UNIONS ARE REPRESENTING THE WORKERS. IT’S NOT SAYING [INAUDIBLE] I’M NOT SAYING-I’M NOT IN THE MOST LIKE WE NEED THESE JOBS TO PROVIDE FOR OUR FAMILIES AND WE NEED TO BE ABLE TO DETERMINE WHAT THAT LOOKS LIKE SO WE DON’T JUST HAVE TO ACCEPT ANY JOB THAT’S GIVEN TO US. THESE WERE GOOD JOBS THE PAST BUT NOW THAT WE KNOW WHAT WE KNOW ABOUT THESE INDUSTRIES THIS IS THE REALITY WE HAVE TO FACE WE FACE IT NOW AND WHO DO WE LET BEAR THE BURDEN OF THAT? WAS MY COMMENTS. PLEASE; OPPOSE THIS BILL AND THAT THE PUC CONTINUE WITH THIS PROCESS THAT IT’S BEEN DOING FOR TWO YEARS.>>CHAIR GAROFALO: ANY PERSON AND MEMBERS WE HAVE GONE ONE PASS OUR DEADLINE BUT I DO HAVE A STANDING RULE THE WHEN FORMER VICE PRESIDENTIAL CANDIDATES NATIONAL TICKET ARE RUNNING WE HEAR FROM THEM BEFORE WE RECESS. SO WE WILL GO TO ANY PERSON AND THEN [INAUDIBLE]. WELCOME TO THE MEHDI. STATE YOUR NAME FOR THE RECORD AND PROCEED WITH YOUR TESTIMONY.>>TESTIFIER: THANK YOU; MR. CHAIR MEMBERS OF THE COMMITTEE. MY NAME IS ANNIE PEARSON AND I WORK WITH THE MINNESOTA 350 ORGANIZATION AND SO IT’S MY PRIVILEGE TODAY TO CARRY WITH ME THE VOICES OF THOUSANDS SUPPORTERS ACROSS THE STATE AND TENS OF THOUSANDS OF OUR NATIONAL 350.ORG WHO PROVIDE INPUT TO THE PROCESS THAT HAS HAPPENED SO FAR. TOWARDS REVIEWING THE LINE 3 PIPELINE PROJECT. I WANT TO BEGIN BY MAKING JUST A COUPLE OF CORRECTIONS WITH ALL RESPECT IF I MAY ON THE RECORD REPRESENTATIVE FABIAN ABOUT THE SUMMARY OF THE BILL. AT THE BEGINNING A QUICK NOTE ON ST. CLOUD THAT HEARING WAS CANCELED BECAUSE OF THE VENUE HAD ANOTHER EVENT THAT WAS GOING TO AT THE TIME IT WAS NOT CANCELED BY THE ALJ. THAT’S THE MINOR CORRECTION. THE MAJOR CORRECTION IS THE EXPERT REVIEW IS FINISHED AT THIS TIME. BECAUSE I JUST DON’T THINK THAT IS TRUE. THE PIECE OF REVIEW THAT REMAINS TO BE DONE IS CALLED THE TRIBAL CULTURAL SURVEY AND IT’S DONE –THIS ONE WILL BE DONE BY [INAUDIBLE] IN COOPERATION WITH THE ARMY COURT AND HANDLED BY A CONSULTANCY THAT DOES THESE ISSUES AND CONDUCTED BY EXPERT MEMBERS OF-WHO BEEN TRAINING FOR THIS PURPOSE AND ARE THE EXPERTS IN OUR CULTURAL PROPERTIES IN THEIR COMMUNITIES. SO TO SAY THE EXPERT REVIEW IS FINISHED AND WE HAVE ALL OF THAT DISCOUNTS TRIBAL KNOWLEDGE OF ANYTHING THAT WE SHOULD POTENTIALLY CONSIDER. CERTAINLY; CUTS IT OUT OF THE REALM OF ANY EXPERTISE THAT’S WORTH LOOKING AT AS SOMETHING WAITING; SOMETHING CARRIES AN EXPERT TEST TO IT. TO ME; THAT IS SOMETHING THAT I WOULD HOPE THAT WE WOULD LOOK AT DIFFERENTLY AFTER LEARNING THAT KNOWLEDGE ABOUT THE CULTURAL SURVEY STILL BEING YET TO BE ENTERED INTO THE RECORD HERE. WE KNOW THAT IT’S IN PROCESS AND THAT IT’S GOING TO BE FINISHED BY THE END OF SUMMER AND AT THAT POINT ME WE CAN SAY THE EXPERT REVIEW IS COMPLETE BUT UNTIL THAT POINT; WE CANNOT. SO IT’S ALSO BEEN MY PRIVILEGE TO TRAVEL TO MANY; I BELIEVE ALL; ACTUALLY; THE HEARINGS THAT HAVE HAPPENED ON THIS PROJECT IN NORTHERN MINNESOTA AND IN THE TWIN CITIES FOR BOTH THE ENVIRONMENT IMPACT STATEMENT PROCESS AT THE DEPARTMENT OF COMMERCE AND THE CERTIFICATE OF NEED AND ROUTE PERMIT PROCESS THROUGH THE CONTESTED CASE HEARING ON BY ADMINISTRATIVE LAW JUDGE O’REILLY. THAT’S 22 MEETINGS ON THE EIS AND 16 INSTEAD OF 18; 16 ON THE CERTIFICATE OF NEED. SO I WILL OFFER A PERSPECTIVE FROM HAVING VISITED THOSE THAT CHARACTERIZING IT AS FOLKS IN NORTHERN MINNESOTA OVERWHELMINGLY BEING FOR THE PROJECT BUT I WILL SAY YOU ARE AND I WERE ATTENDING DIFFERENT HEARINGS. I KNOW THAT YOU HAVE ATTENDED HEARINGS AND I TRUST THAT YOUR YOU SAW WHAT THEY SAW BUT I WOULD MENTION THAT YOU ARE NOT MANY OF THE HEARINGS THAT I WAS AT AND HAVING ATTENDED ALL OF THEM OVERWHELMING SENTIMENT EVEN INCLUDING MUCH OF NORTHERN MINNESOTA INCLUDING THE MAJORITY OF THE NORTHERN MINNESOTA HEARINGS WAS AGAINST THE PROJECT. IT WASN’T THAT WAY THE RIVER FALLS BUT WERE MORE SUPPORTERS OF THE PROJECT THAN THE WERE OPPONENTS OF THE PROJECT IN THIEF RIVER FALLS. I WAS ONE OF VERY FEW HEARINGS THAT WAS THAT WAY. SO THINK ABOUT THIS NOT SO MUCH EVEN AS A NORTHERN MINNESOTA GREATER MINNESOTA VERSUS THE TWIN CITIES ISSUE; BUT RECOGNIZING PEOPLE AND POPULATIONS FEEL DIFFERENTLY AT DIFFERENT PLACES AND THAT IT’S DIFFICULT AND IT’S PROBLEMATIC TO GENERALIZE THAT FOLKS UP NORTH SUPPORT THE PROJECT MY DIRECT EXPERIENCE AND I BELIEVE THE HEARINGS TRANSCRIPT WOULD IN FACT BEAR ME OUT AND BUY IN LARGE THEY DO NOT SUPPORT THIS PROJECT. SO WITH THIS COMES DOWN TO HIS QUESTIONS OF PROCESS AS QUESTIONS OF TRUST. TO ME; THE CONVERSATION ABOUT WHILE THE REVIEW IS DONE AND THE EIS IS DONE; AND THEREFORE WE HAVE THE INFORMATION THAT THIS ROOM NEEDS TO MAKE A DECISION THAT’S A BIT BIZARRE TO ME BECAUSE IT WAS ALREADY NOTED EARLIER TODAY THAT THE SAME BILL WAS UP LAST YEAR AND LAST LEGISLATIVE SESSION WHEN NONE OF THE REVIEW WAS DONE SO IF THERE WAS AN EFFORT TO PUSH THE SAME BILL LAST YEAR WHEN NONE OF THE REVIEW WAS DONE WE DO NOT EVEN HAVE A DRAFT RELEASE I THINK AT THAT TIME. IF WE DID IT WAS THE DRAFTTHAT HAD JUST DROPPED IT I DON’T EVEN THINK WE HAD ONE BECAUSE THE HEARINGS WERE IN JUNE ON THE DRAFT. HE CERTAINLY DID NOT HAVE A FINAL. WE DO NOT HAVE ANY OF THE EXPERT TESTIMONY HE DID NOT EVEN HAVE THE INTERVENERS FINALIZE. NONE OF THAT RECORD HAS BEEN DEVELOPED. SO IF YOU ARE IN A POSITION NOW WHERE YOU ARE SAYING YOU’RE GONNA LOOK AT THAT AT THAT DATA ICE WOULD SAY IF I WOULD KNOW THIS WAS INTRODUCED LAST YEAR THAT MIGHT’VE BEEN PART OF ME THAT WOULD HAVE BELIEVED YOU BUT KNOWING; KNOWING; YOU ARE READY TO GO FOR IT LAST YEAR WITHOUT ANY OF THAT THAT GIVES ME NO FAITH THAT YOU WOULD CONSIDER TAKING A LOOK AT THE RICH RECORD THAT’S BEEN DEVELOPED NOW I JUST DON’T SEE IT. SO ISSUING THE APPROVAL THIS WAY LEGISLATIVELY; WITHOUT THE PERMITS WOULD IT ALLOW FOR ANY CONDITIONS INCLUDING MAJOR CONDITIONS THAT BEEN RAISED EVEN BY THE DEPARTMENT OF COMMERCE; EVEN SAYING; IF YOU WERE TO GO FOR APPROVAL EVEN THOUGH WE ARE RECOMMENDING NOT TO HERE’S A BUNCH OF CONDITIONS THAT WOULD BE VERY HELPFUL. THESE INCLUDE CONDITIONS TO PROTECT LANDOWNERS. SOME OF THE CONDITIONS ON PIPEL INE ABANDONMENT. WOULD BE DISCUSSING WIT H ANY POSSIBILITY OF PROTECTING PEOPLE TO THOSE CONDITIONS. THAT WOULD ALSO LEAVE NO PERMITS FORMALLY ISSUED FOR THIS PROJECT OTHER THAN THIS BILL AND THAT MEANS THAT THERE WOULD BE NOTHING TO REVOKE IN THE EVENT OF ANYTHING HAPPENING LATER ON WITH A PUBLIC WOULD NEED TO BE PROTECTED AND AVERAGE MIGHT POTENTIALLY NEED TO BE HELD ACCOUNTABLE FUTURE STAT E GOVERNMENT. OUR REGULARS WERE NOT HAVE THAT WILL BECAUSE NO PERMITS WOULD HAVE AN ISSUE COULD WE HAVE IN FACT SEEN THAT AND UPON THE COMMERCE IS ARTICULATED ABOUT THE CURRENT LINE 3 PIPELINE BECAUSE IT WAS MADE BEFORE WE HAD OUR CURRENT LATORRE PROSECUTE>>CHAIR GAROFALO: JUST REMINDER I DON’T WANT TO HAVE TO RESET THE COMMITTEE SO IF YOU COULD WRAP IT UP; PLEASE.>>TESTIFIER: THANKS. I’M ALMOST THERE. THE QUESTION OF NEED IS DEFINED BROADLY IN THE REGULATIONS THAT GOVERN DECISION AT THE PUBLIC UTILITIES COMMISSION I DON’T HEAR A SIMILAR UNDERSTANDING OF NEED FROM THIS COMMITTEE TODAY. AS AN UNDERSTANDING OF NEED THAT TAKES INTO ACCOUNT THE PUBLIC GOOD LOOKS AT THE OVERALL COST AND BENEFITS TO SOCIETY AND THAT’S WHERE COMMISSIONERS ARE LOOKING THAT’S THE BETTER PART OF COMMERCE IS MAKING RECOMMENDATIONS BASED ON. I’M NOT HEARING THAT. AT OF THE COMMITTEE TODAY. I’M NOT I DON’T THINK THAT’S EVEN BEEN BROUGHT UP. SO TO WRAP UP; I DON’T THINK THAT WE WANT A PROCESS THAT IS A SHAM OR THAT’S A JOKE. I DON’T THINK WE WANT THAT. PASSING THIS BILL WOULD MAKE THIS PROCESS A BIT OF A JOKE. GOING BACK TO THE QUESTION OF WHAT SHOULD WE TELL PEOPLE; WHAT SHOULD WE TELL THE PEOPLE WHO WERE ACCOUNTABLE TO WHAT SHOULD I TELL THE PEOPLE THAT AT THIS POINT TENS OF THOUSANDS OF PEOPLE WHO SPENT THEIR TIME INVESTED IN THIS PAST; WHAT SHOULD WE TELL THEM. WHY SHOULD ANYBODY PARTICIPATE IN THE FUTURE THE STATE OF MINNESOTA ASK THEM FOR INPUT WHAT IS ANYBODY’S INCENTIVE TO DO IT IF WERE NOT WILLING TO THROW IT OUT THE WINDOW. SO PLEASE; DON’T. [APPLAUSE]>>CHAIR GAROFALO: WELCOME TO THE COMMITTEE.>>TESTIFIER:>>TESTIFIER: [NON-ENGLISH SPEAKER] MY NAME IS WINONA DO. I CAME FROM FAR AWAY. [INAUDIBLE] I LIVE A LITTLE BIT SOUTH FROM DON GOODWIN I WHICH IS A YOU SHOULD BE GET OUT MORE. [LAUGHING]. I WAS IN A SUGARBUSH THIS MORNING GREAT SIPPING IN THE STATE OF MINNESOTA RIGHT NOW. I’M SAYING WE’VE GOT A GOOD PRETTY GOOD PLACE I LIKE TO KEEP IT TH AT WAY. IF YOU GOT OUT YOU COULD SEE SOME THE COOL STUFF GOING ON OUT THERE. I JUST HAVE A FEW REMARKS AND I DO APPRECIATE YOUR TIME. I KNOW YOU HAVE BEEN HERE A LONG TIME TO THE FIRST THING I WANT TO SAY JUST LIKE EVERYONE ELSE IN THE ROOM WE WANT A SYSTEM THAT WORKS. WE PUT OURS; DAYS; A LOT OF OUR LIFE BLOOD SWEAT AND TEARS INTO THIS PROCESS YOU WANT A SYSTEM THAT WORKS INCLUDING [INAUDIBLE] CIRCUMVENTED TO EVEN TO SUGGEST SUCH A PROPOSAL AS THIS WHEN THERE’S FIVE TRIBES WHO HAVE INTERVENED IN THE PROCESS EVERY OJIBWE TRIBE IN MINNESOTA HAVE EXPRESSED THEY DO NOT HAVE THIS PIPELINE TO SHOVE IT DOWN OUR THROATS I FEEL LIKE SAYING IF YOU WANT TO GET ALONG OR NOT. AT SOME POINT WE NEED TO LEARN HOW TO GET ON BECAUSE WE’RE NOT GOING AND APPEARED SEVEN A BIT OF THE OJIBWE TRIBES THAT PRECEDED THE STATE OF MINNESOTA WITH HER TO BE GOOD NEIGHBORS WITH EVERY ONE OF THE. SECOND; ON JOBS; TO UNDERSTAND SOME YOUR CONCERNS. BY TRAINING; RURAL DEVELOPMENT ECONOMIST. SOME YOU MAY OR MAY NOT KNOW WHAT TO HARVARD UNIVERSITY IN THE MASSACHUSETTS INSTITUTE OF TECHNOLOGY. MY EMPHASIS IS ON HELPING PEOPLE [INAUDIBLE] AND IF YOU WANT TO LOOK AT JOBS IN THE NORTH THIS IS NOT YOUR ANSWER. THIS WHEN I BRING US ANY MORE JOBS BUT IN FACT I WANT TO JUST POINT OUT [INAUDIBLE] WHICH IS IN REPRESENTATIVE GREENE’S DISTRICT AND WHAT I WOULD SAY THERE IS THIS. THE TOWN O F CLEARBROOK HAS A LARGE AVERAGE TERMINAL IN IT. AND 80 ACRE AVERAGE TERMINAL IN THE TERMINAL HAS 15 EMPLOYEES. THAT’S BECAUSE MOST OF IT IS AUTOMATED. THE PROPOSAL ITSELF WOULD OPERATE A LOT OF NEW JOBS TO THE STATE JUST GOING TO GIVE YOU AN EXAMPLE. THE TOW N OF CLEARBROOK. THERE’S A STORY OF THE TOWN OF CLEARBROOK WHICH IS IN DECEMBER; THE NURSING HOME AND CLEARBROOK CLOSED OUT. IT HAD 53 WHO WORK THERE NONE OF THOSE PEOPLE HAVE JOBS NOW THAT’S MANY MORE JOBS THAN AVERAGE PROVIDED THE RE AND ALL THE ELDERS WHO LIVE THERE ARE NOW TRYING TO FIND A PLACE TO GO. IT’S REALLY UNFAIR BUT IF WE WANT TO TALK ABOUT RURAL JOBS WE ARE WE IN PITCHING FOR THE GOOD SAMARITAN NURSING HOME ? TO KEEP ELDERS IN THEIR COMMUNITY? THAT’S BASICALLY MY CONCERN ABOUT THE OTHER THING I WANT TO SEE IF YOU WANT JOBS I N THE NORTH WE CAN DO ABOUT CLEANUP JOBS. THE OTHER PEOPLE TESTIFIED THE FACT THAT IMAGE [INAUDIBLE] FEDERAL COST $2.8 BILLION TO REMOVE THE PIPE. THAT DOESN’T MEAN NEW PIE. THAT’S LABOR. $2.8 BILLION WITH A PIPE TO BE REMOVED. I BELIEVE THAT WOULD BE A VERY GOOD USE OF THEIR RESOURCES . [INAUDIBLE] SET A GOOD PRECEDENT FOR THE OTHER PILOT 55 LENGTH OF SITTING IN NORTHERN MINNESOTA RIGHT NOW ALL OF WHICH AT SOME POINT WE NEED TO BE REMOVED. SO IF YOU WANT TO DO OUR JOBS I WOULD SUGGEST WE LOOK AT LONG-TERM JOBS AND PROTECTING OUR ENVIRONMENT AND ALSO PROVIDE JOBS FOR IRONWORKERS. FINALLY I WANT TO SAY [INAUDIBLE] JOB OPPORTUNITIES IN THE NORTH. SOME OF YOU HAVE NOTED I’M SURE SADLY THAT [INAUDIBLE] HOWEVER THE STATE OF MINNESOTA HAS A NEW FACILITY THERE BUILDING IN THE IRON RANGE. IS AN EXCELLENT IDEA. FOR JOBS IN THE NORTH COUNTRY. MY PERSONAL SUGGESTION IS THAT WE LOOK AT LONG-TERM JOBS THAT WOULD UNIFY US. NOT THAT WE ARE SEPARATED WE ARE ALL HERE FOR THE LONG TERM AND THE FACT IS THE LONG-TERM ECONOMIC PROSPECT BE BETTER TO A LOT OF STRONG ECONOMIES REALLY USE LESS ENERGY AND PROTECT OUR ENVIRONMENT. PARTICULARLY; FOR PEOPLE IN THE PHEROMONES BUT I JUST WANT TO SAY ONE LAST POINT ON THIS. I [INAUDIBLE] IN THIEF RIVER FALLS. I’VE A STATE PERMIT TO GO [INAUDIBLE] I’VE BEEN GROWING INDUSTRIAL HEMP FOR TWO YEARS IN THE STATE OF MINNESOTA. I WANT TO GROW INDUSTRIAL HEMP FOR FIBER I WANT TO GROW IT FOR A MILL. IT TURNS OUT THERE NEEDS TO BE 11 HEMP MILLS IN THE STATE OF MINNESOTA. UNTIL THE 1940S WHICH [INAUDIBLE] EMPLOYED THOUSANDS OF PEOPLE. IT TURNS OUT THIEF RIVER FALLS ITSELF USED OF A MILL WHICH GREW FIBER WHICH WAS A FLAX MILL. WHAT I NEED IS A MILL. THAT COULD BE IN THIEF RIVER FALLS. IT COULD EMPLOY A LOT OF PEOPLE. I’M SAYING LET’S MOVE TO THE NEXT ECONOMY ONCE THAT’S NOT GOING TO [INAUDIBLE] THAT JUST GAVE $5 MILLION IN LOBBYING T O THE STATE OF MINNESOTA LET’S NOT GET INVOLVED WITH. [INAUDIBLE] A MAKE A GOOD ECONOMY FOR THE FUTURE OF OUR NORTH COUNTRY. BECAUSE I’M FROM THE NORTH COUNTRY AND FINALLY; LET’S FIGURE OUT HOW TO MAKE A CIVIL SOCIETY AND THE STATE OF MINNESOTA THAT WORKS WELL WITH OTHERS. YOU DON’T WANT TO LOOK AT ME FOR THE NEXT 20 YEARS AND SAY; LET ME JUST SCREW THE INDIANS ONE MORE TIME. YOU DON’T WANT TO DO THAT. IT’S NOT THE RIGHT THING TO DO THIS THE OPPORTUNITY TO DO THE RIGHT THING. THANK YOU FOR YOUR TIME. [APPLAUSE]>>CHAIR GAROFALO: WE HAVE FIVE TESTIFIERS LEFT MEMBERS. IT’S TAKEN US ABOUT 100 MINUTES TO GO THROUGH 13 TESTIFIERS. SO MY GUESS IS IT WOULD TAKE PROBABLY 45 MINUTES FOR THE EXPECTED SO WE ARE GOING TO RECESS TO THE CALL THE CHAIR UNTIL APPROXIMATELY 615-6:20 PM. JUST I’LL BE IN TOUCH WITH REPRESENTATIVE MAHONEY FOR DFL MEMBERS AND REPUBLICAN MATTERS I’LL BE IN TOUCH WITH THE COMMITTEE ADMINISTRATOR SO WE ARE RECESS TO THE CALL THE CHAIR AND WE WILL COME BACK AND BEGIN PUBLIC TESTIMONY. THANK YOU.>>[GAVEL]>>[RECESS]>>
